UKPC and Disabled Parking Notices

Hello All,

I don't normally join in as I don't have a lot to say as I try to read things rather than give out poor advice.

But today, whilst in Currys store in Cheltenham Gloucestershire I was parked in a disabled bay

I am disabled. I do have Blue badges. But being a bad day I just forgot to pop them on the dashboard.

I was in the Currys store pricing up an item. one heading back to the car I noticed a yellow sticky on the window of the car with a Fine of £60 for parking in the disabled bay.

I went back in store and spoke to someone that basically said, even though I was parked in front of their store and on private land and that I was in his store. that he could not do anything about it but he might sort a better price out if I bought in the store.

So, Not only do I have a crappy lifestyle from being disabled, I get a £60 notice for not showing blue badges and then the store assistant turns around and gives me 3rd kick in the ribs.



I have been reading and trying to take the information it that you all have spent an age sorting out for idiots like me but I still can't take the information in.

can someone Please, in layman terms, be able to tell me if I have to spend my weeks shopping on this.

It was issued on private land by UKPC.

Parking in a disabled person's space without clearly displaying a valid person's badge


I'm a little upset on this at the moment so my apologize if the above is badly worded.

    But would you come on the board and bleat about someone parking in a blue badge bay without displaying a blue badge ?, I take it parking in the disabled bay would be free, therefore no requirement to pay, unlike every other bay which has to be paid for, much as I have sympathy for all parking invoice victims, it applies to us all.

    there is no evidence that any of these parking pays are pay and display, neither the non-BB ones or the BB ones, you are making terrible assumptions there with no facts

    plus this person PAYS for the BB, whereas joe bloggs doesnt

    the bays are there under the EA2010, which this person qualifies under, nothing to do with their BB and not everyone who qualifies as disabled can obtain a BB but by law can park in those spaces

    most retail parks and supermarkets are free to park so that the retailers get your business - find out the managing agents of this retail park and complain to them

    Wait for the Notice to Keeper to arrive (29 - 56 days after the parking incident).

    Read NEWBIES FAQ sticky, so that when you get the NtK you are ready to act.

    As a disabled person you are covered by the Equalities Act 2010 and adjustments need to be made. Blue Badges are not legally required for parking on private land. With or without a Blue Badge you are still disabled. You will need to get in touch with the organisation who contracted UKPC (I doubt it was Currys - more likely a management agency, so you'll need to do a bit of digging to find out who they are), and inform them of your situation. Remind them that the EA 2010 provides you with the option to sue them - minimum reparation of £500.

    Read up on the EA 2010 to explore your rights and options.

    The short answer is No you dont have to spend your shopping money, or any other money on this, but you may need to spend a little time to get your head around things.

    thats a common response, were there other stores sharing the car park?

    Just for happychappy. its free parking for all if your in the store, which i was. maybe you would like to swap places for a few weeks with a disabled person, then i think you might find that blue badge is least of the problems

    no , not in england or wales you cant , you could leave yourself wide open to a court claim

    you should do as the newbies thread and previous replies told you to do

    wait for the NTK and appeal it on legal grounds

    also complain to the managing agents of the retail park, threatening court action under the EA2010 , again on legal grounds

    almost all the replies have told you in laymans terms what to do, its now your job to follow that advice

    no please re read the sticky you will need to challenge it.
    if you can find out the land owner ( where was the retail park ) then it should be a simple process just show thenm a copy of your badge and the landowner as principal should be able to cancel

    What?

    Where in the advice you've sought from us has anyone suggested ignoring the charge?

    It needs tackling and a number of regulars have given you sound advice.

    If you ignore this charge, you will be back again in a few weeks time asking us for help in dealing with debt collector letters.

    Maybe a few months after that you'll be asking us for help in defending court papers. UKPC is not one of the uber litigious PPCs, but they did issue 34 court claims last year.
