ParkingEye advice please

Hi folks,
I have unfortunately received a letter from ParkingEye for overstaying in a 'free' carpark. This carpark used to have a limit of 3 hours, some time ago this got reduced to 2 hours & unbeknownst to me, recently reduced yet again to 1 hour & 20 minutes. My stay was apparently 1 hour & 31, taking me a whole 11 minutes over this new limit, for the privilege of which ParkingEye would like to charge me £85 :mad:!
A friend of mine is advising me to ignore all the letters (which he did 3 years ago apparently), the other option I believe is to appeal? However, I've recently been reading about poor old Barry Beavis from Billericay who ignored the letters but ended up in court with ParkingEye winning the case
. So is all hope lost? Any thoughts or advice would be very welcome.

As I wrote in a recent post, ask your friend if s/he will write your court defence and underwrite any costs against you if you continue to follow their 'ignore' advice. That will test their confidence in that advice! We need many more 'friends' to be suitably educated!
You need to do some investigation as to the validity of the continuing downward time limits being implemented at this car park.
You need to check with your local authority planning department as to what the original planning consent said. You should check this out too with the landowner - did they decide this, was it done as a result of pressure from PE, was it a result of a unilateral decision by PE?
But none of the above should deflect you from following the appeals procedures as per the NEWBIES FAQ sticky.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

DON'T IGNORE PE. They are extremely litigious. READ and digest the NEWBIES thread is the first thing to do.
You have quite a bit to do and you mention reductions in free parking period.
It will be worth checking with the local authority to see whether they have any control powers over this car park and whether permissions were required.REVENGE IS A DISH BETTER SERVED COLD0 -

Are there receipts or bank/cc statements to prove this? Real 'get out of jail' cards.
Aldi sites across the country are notorious for the reduction of parking time limits in direct contravention of local planning consent. And guess what - PE are always involved. ok , I have got off one of those about 6 mths ago, there are docuaments at the town hall to show that it should be car parking for non users and 3 hrs are shown , this was to stop cars driving from one car park to another,
you can challenge them on that , and even threaten to produce the PDF in court , however,
the easiest way , is to gather your receipts and pray that the ones from aldi , and the other shops on the site come close to about £30,
you can then ring aldi , ask for there parking section , and offer to email them over , and they will hopefully cancel the charge0 -

Thanks for the replies so far. I'll not be ignoring the letters then! Will have a read of the Newbies thread also.
With regard to Aldi, I did do a shop there on that date but after finding no reference on my bank statement it seems that I must have paid cash on that visit so it's a long shot as to whether I'll have the receipt but I'll have a damn good look.
Very interesting to hear that documents in the town hall show that the parking should be 3 hours, I'll certainly investigate that if I can't find the receipts. Is that how you got off Enfield Freddy?0
