vendors leaving rubbish in the garage

The vendor didn't tick the "clean and tidy" box on the form, but my solicitor advised we had protection under vacant possession. They have not only left all the tenants' furniture, but a ground floor full of rubbish including a lounge 4.5 by 5 m piled 1m high, and a kitchen full of registration forms for "get rich quick seminars" (about 30 crates). It has all in all been estimated as 8 skips worth. The owners claim I agreed to this, I dispute and am unable to move in until it is cleared. I fully intend to reclaim costs via small claims process. Would be interested to hear stories from those who have gone down that route.0
