    maybe so, but it was stupid to ring in, if he had told you to put your hand in a fire, you wouldnt do that, or you would seek advice BEFORE burning your hand, phone calls never settle these parking issues

    we cant debate the issues regarding not following the correct forum advice

    the advice is that the RK waits for the NTK, that is my advice, either do so, or dont , its your choice

    20 days now since the ticketed offence
    not heard anything from them

    any need to write to them and appeal or still sit tight?

    you havent digested the NEWBIES info

    the NTK cannot arrive in the first FIRST 28 days as they cannot apply for RK details to the DVLA in that month, they have to wait a month and then the NTK has to arrive between DAY 29 and DAY 56 for it to be valid under POFA 2012

    do the math !

    To be honest a lot of the stuff advising what to do is quite confusing.
    Its ok when you know what you're doing and or have appealed/waited etc before but if its the first time then its a bit complicated and the format of how stuff is scattered around makes it even harder, so go easy eh

    yes and no

    yes it would not be valid under POFA 2012 meaning that the RK or keeper has a valid point of defence (that POFA 2012 does not apply)

    they can still try to enforce the charge under small claims court for up to 6 years, but the RK can claim that POFA does not apply, so go chase the driver, who will not be named , so in theory a judge would throw it out

    thay can still send debt collector letters etc, but the above still applies, the RK stands their ground and does not name the driver

    the PPC IS TOLD TO CHASE THE DRIVER, WHO WILL NOT BE NAMED

    so catch 22

    some PPC`s dont even follow pofa, preferring the old methods of trying to sc@m the RK or to wheedle out the drivers details by fair means or foul means so they can chase the driver and so pofa would not apply anyway (as it only protects the keeper)

    this 29 to 56 days is just a requirement if they wish to chase the keeper under POFA 2012 , it does not negate the invoice

    the longer they fail to follow the "rules" the harder it would be for them to convince any ADR or a judge
