    I would have thought it was a simple case of including in brackets (expect an appeal rejection). Even the newest of members would understand its relevance.

    POPLA do certainly look at the first appeal - mainly to see whether the driver has been admitted. That's a fact. And as CC says, it's evidence the PPC has to show POPLA.

    Hence why the MSE advice is currently still fairly awful (sorry).

    A third person appeal, not saying who was driving, is vital. That's why the Newbies version is written that way - but people can alternatively try a 'here's the driver's receipt' shorter appeal of course (BUT NOT 'here are my receipts'). Not 'I did put the permit on the windscreen' but yes to 'the driver did put the permit on the windscreen'.

    And DO NOT appeal if it's not a BPA or IPC member (I think MSE says appeal which is ridiculous, like handing your details to a phishing emailer!).

    unless the MSE advice is changed and agreed by the dedicated forum members (which it has never been despite the survey on here last year) then the NEWBIES sticky thread is still the best source of info for newbies and experts alike

    newbies should not be sending pm,s to a board guide unless they want their thread merging or some other forum based issue that only a board guide can resolve

    they certainly are abusing the system by asking a board guide for help, that is not the role of a board guide

    they should be posting on the forum and asking for help, that is what the forum is for

    I have been coming here for about 2 years now and I have never known a parking company to routinely cancel when challenged by any template of any sort or description

    greed and profit means they reject maybe 99% of these appeals so it will happen regardless of which template or advice they follow

    its inevitable due to greed and ignorance

    as board guide, reply and tell them to post on this forum and not to ask any staff member for bespoke help, due to the fact that it isnt in your remit to offer such help

    agree a template response , keep it in notepad and copy and paste it back to any such pm , with links to this forum and the NEW THREAD button

    if they have an existing thread, tell them to post in it

    I moderate and admin on other forums, where similar pm,s go to staff members about the topics , be it car repiars, insurance, equipment problems etc, all irrelevant to a staff member, you pm them as a reply and tell them to use the forums where experienced members may and usually do answer them

    if MSE changes the MSE advice to a useful set of guidance and templates etc, then and only then should you remove the bespoke advice given in the NEWBIES thread

    ie:- when coupon-mad agress it should go, then it should go, but not before

    having no advice at all wont stop the pm,s

    having bad advice is worse as MSE is held responsible for the bad advice

    the forum staff here have been told this on numerous occasions, they even tried to fix it last year (mse-marcel ? rings a bell)

    but they failed and so the saga continues

    whatever you do, you wont stop 99% of the appeals failing, due to profit and greed, and due to the PPC,s knowing the prey dont know the basics

    and yes POPLA do get copies of the claimant pcn and the initial appeal by the apellant , but popla only go for certain aspects and ignore other pertinent info, like the EQUALITY ACT and blue badges etc - which they especially ignore

    There is also the Beavis case which doesn't seem to be helping, because although it's being appealed to the Supreme Court, some PPCs are already using that as a rebuttal to the template letter's assertion that the charge is not a genuine estimate of loss.

    Crabman - if you were a newbie posting, we'd be firmly telling you several things after that post:

    POPLA don't judge any '1st appeals/pleas/letters' sent to private parking scumpanies, but they will check to see if driver i.d. was admitted or implied. [Newbies sending those will rarely know POPLA exists.]

    POPLA is the 1st impartial adjudication level, applying points of civil law.

    DON'T USE 1st PERSON.

    MITIGATION IS NOT GROUNDS FOR APPEAL, although you can link relevant explanation to a POPLA Appeal point.

    Unfortunately, Official MSEB]not Forum[/B advice and stance on parking tickets can seem questionable and 'stories' are usually well behind the curve ball.

    Like Collies Carer, I too was a parking forum newbie and saw off 2 parking lie tickets and since, an apcoa/Southwark Council one, entirely thanks to these Threads. I would echo her post in every particular.

    Crabman - try:
    'I do not accept pms relating to parking tickets. PLEASE START AND STAY ON YOUR OWN THREAD' should do it, with a link to Newbies Stickies, crediting c-m:D

    POPLA do see the first appeal though, that's why you cannot and must not say who was driving in that appeal, and NOT choose 'driver' in any online drop down menu!! (UKPC and PE spring to mind).

    But you CAN send receipts from 'the driver' (ParkingEye will cancel for certain sums on a receipt, easy peasy).

    POPLA do see the initial appeal made to the PPC, which is why we tell all apellants they dont need to include those details in any popla appeal, due to the parking company providing them

    well after receiving some info today , I think we are about to see the end of the laws brought in in 2012 , yes clamping will still be banned , but will the BPA (ata) and the IPC still be with us?


    gone will be the days of NTKs and appeals


    with the info in the post below , you will see that by quitting the BPA and IPC you can join the The Credit Services association , and just go straight to the dvla the DCA then CC papers
