Hello,
Last May, I agreed to have a three year fixed rate contract with XLN for my shop telephone, In February of this year I noticed from my bank account statement that, the direct debit to XLN was increased by more than 55% compared to the previous month. I immediately contacted them as we never make any outgoing calls. I was told that even though I was told at the timing of agreeing to the contract that my rates will never go up during my year three contracts but apparently the increase of more than 55% of line rental was within their terms and conditions. The terms and condition which was not told about at all, otherwise I would have not agreed to the contract in the first place. Furthermore they say that I was sent a letter in January and had 30 days to respond as I did not. I am no longer able to cancel the contract unless I pay £200 cancellation charges. After a few phone calls and email I finally managed to get a copy of the letter. After seeing the letter I sent an email to them (see below) hoping that they would reconsider but all my emails are now being totally ignored. I hoping that I will be able to refer the case to OFCOM, but I felt I must warn other people about XLN
“I would also like to inform you that last week I have finally received your undated so called the letter of price increase Notification. However I can confirm that I had never received this letter. Even though I am not sure, had I received it, it would have prompted me to take any action, as it fails to offer any information about my account for me to recognise the relevance of it to me. The letter lacks many basic information to be considered as a price increase notification letter. It appears to be just a marketing mail shot and most probably I would have treated as such. It has not been marked with any date; it does not address me directly nor contains any specific about me, my account details or my phone number. No reference has been made, what so ever, about people who had signed up to your fix contract. Furthermore contrary to what your colleague told me that, there is a detailed explanation in the letter about the price increase of more than 50% on supposedly my three year fix term contract, furthermore I was told that in letter there was confirmation that I had 30 days from the date of the letter to terminate my three year fix contract with no cancellation charge and as I did not take any action the cancellation charges applies now. Contrary to what your colleague, in the cancellation department said, no such information could be found in your letter”.
