Smart Parking at Asda

Hi All,
I am wondering what to do as I have received a £40 pound charge today from Smart Parking Ltd because I used an Asda car park for more than 2 hours on a Sunday evening.

I did not think it would be an issue as the shop was closed the car park had about 5 cars in it and about 300 empty spaces and I originally went to Asda to buy a tv cable, forgetting it would be shut. After the dissapointment of not being able to purchase we spotted weatherspoons and went for a meal.

I live about 150 miles from the store and was not aware of the parking restrictions , I have no way of returning to look at the signs, I was not able to complete a purchase that day but do shop occasionally in Asda. On reflection it appears if Asda want treat adhoc customers like this then yes I may have been in the wrong.

I am interested in your thoughts people.

Should I pay £40 now , I am a born worrier and its probably worth £40 now to end it and I don't see what grounds I have to fight it?

Or should I ignore it as I hate being ripped off and this does not seem legally right after reading lots of threads.

A lesson has been learnt already I now realise I have to check sign-age in every supermarket car park even when they are closed.

    I ask as i collect these tickets by the bag full and have visited over 400 of their stores.

    You can see from any of my previous posts that I am not a supporter of PPCs and their ludicrous penalty charges. (Yes, the charges are, in my view, a penalty way out of proportion to the infringement.)

    However, I never cease to be amazed when motorists don't check the restrictions on the signs given all the publicity that there has been on private parking of late.

    Yes, I will continue to advise and help all those stung by the scavenging PPCs, but a part of me does believe that anyone who parks their car in any car park in 2015 without looking for and reading the signs brings down the consequences on their own head.

    I do not condone the charges imposed, but a quick read of the t&c would avoid all the hassle that many OPs on here have faced as a result of not bothering to check properly.

    I can say one thing, since getting my fist ever PCN last month, and being educated by you guys on here, I am amazed at the abuse of the system that goes on by these verminous companies, its nothing more than straight theft by some of them, and I now go over the signs in great detail on every car park I enter..
    I am seeing signs in car parks I have used for years and never even knew were managed ones...
    Its totally changed my attitude to parking...

    I have some sympathy with your view GD .... BUT .... until the retailers, managing agents, gyms and supermarkets realise that they are using scammers, criminals, bullies, thugs, twonks, con artists, frauds, crooks, hustlers, cheaters, low lifes, scum, fleecers, idiots, deceivers, sharks and downright unpleasant people to 'manage' their car parks I will continue to help ANYONE ( regardless of how they got a 'ticket' ) and have zero, zilch, nil, zero, nowt, none and no sympathy with those that employ PPCs.

    We do. You are the registered keeper.

    You appeal as the keeper, not saying who was driving. That's what the NEWBIES thread is for, that's why there's a template first appeal, to stop people saying 'I parked' in a silly appeal written about what happened.

    You then appeal to POPLA as keeper - not talking about the driver nor about the 'story of what happened' - and one of your appeal points is that the Notice to Owner doesn't have the required wording from Schedule 4 paragraph 9. Because Smart versions do not, so there can be no 'keeper liability'.

    YOU WIN.

    It is that simple, well worth not shelling out £40 over!
