When is Stopping the same as parking

we have had several comments from the DVLA
In terms of the lawfulness of releasing data for the purposes of VCS’s operations at LJLA, we are assured that the reasonable cause requirements in law are satisfied. It is clear that vehicles stopped in unauthorised areas can present a risk to airport security and can prevent access by emergency vehicles. Drivers are adequately warned of the terms and conditions of the site and are able to use the free pick up/drop off facility. Merseyside Police are quoted as being supportive of the measures in place at the airport. The DVLA does not agree that there has been a breach of Data Protection or KADOE contract. There is no evidence that VCS has breached any of statutory provisions, legislation or other legal requirement affecting the KADOE Service

DVLA takes very seriously its duty under the Data Protection Act to protect the privacy of motorists whose details it holds on its record. Regulation 27 of the Road Vehicles (Registration and Licensing) Regulations 2002 allows the DVLA to release information from the vehicle register to anyone who can demonstrate 'reasonable cause' to have it.
We are not able to provide a definitive definition of 'parking', our responsibility is limited to a lawful release of vehicle data. However we do not consider 'stopping' a vehicle in an unauthorised area to be so different from 'parking' a vehicle in an unauthorised area as to make it incompatible with the KADOE contract.
If the vehicle is considered to be stopped (e.g. occupied) or parked (e.g. unoccupied) in an unauthorised area, this still makes an investigation by the operator necessary, and fulfils the reasonable cause criteria for the lawful release of vehicle keeper data. Therefore we do not consider there to have been a breach of the KADOE contract.
I trust this response clarifies the Agency's position on this matter

this blows the whole KODOE agreement out of the water , as it clearly says PARKING.

They've compounded their stupidity by drawing a distinction between whether the vehicle is occupied or not, which is utterly irrelevant.
The best definition you are going to get is from the rules applicable to the public highway. As any fule kno, you can't park on double yellow lines, but you can stop on them to allow passengers to board/alight or load/unload.
Evidently this isn't good enough for the DVLA so they're making it up as they go along as usual. Anything to protect their £2.50-a-pop stealth tax.Je suis Charlie.0 -

If Liverpool John Lenon Airport believes that allowing VCS / Excell/Simon Renshaw-Smith to operate a honey trap at the airport is an effective security measure, then it could possibly be said that Liverpool John Lenon Airport does not take security seriously, and if thats the corporate view/attitude then how is that reflected elsewhere with the security arrangements both land side and airside at Liverpool John Lenon Airport.?
If you look at it like that then any doubts over security may make you think again about flying from or to that airport.From the Plain Language Commission:

It's an interesting metaphysical question as to whether you would actually be stopped for an infinitesimal period at each change of direction. I'm sure that the DVLA would argue this was sufficient to justify the release of keeper details.Je suis Charlie.0 -
