3rd party hit my car, not yet admitted liability?

    Maybe its a NI thing but I didn't even have to pay my excess when it was the other parties fault, Car in next day, hire car, all without me paying a penny. (other than £20 to change my policy temporarily which I got back later)

    I guess it depends on how quickly the TP admits liability

    Can't you contact his insurance company directly, ask them to deal with it prompto before you get claim management company involved

    What do they get out of it?
    They get commission from the repairer/hire car company/any injury lawyer required etc.

    this is why i dont have a high excess i know it loowers your premium a bit but when situaitons like this happen id rather the insurance take care of it

    even if u have topay out if thes tp you'll get it back

    If you claim directly off the other persons insurance and not via yours you don't pay an excess.
    If you claim via yours your insurer pays out and then claims back from the 3p insurer. when they claim back they claim the excess back for you as well. This takes months from experience.
    I was always taught the first rule of having a car accident is never admit liability.

    Why?

    If the TP knows it's his fault, why not admit liability to his insurers?

    By refusing to admit liability to his insurers, all the TP is doing is pushing up his insurer's costs, and wasting everyone's time. (And possibly increasing his renewal premium.)

    If the TP admitted liability to his insurers, they could arrange hire through their preferred hirers, and possibly persuade the OP to use their preferred repairers.

    Instead, they may end up paying inflated car hire costs and perhaps even an accident management co's inflated prices.

    It's not for policyholders to decide liability.


    Your policy will have a condition that you must not accept liability.


    Tell your insurer the facts and let them decide on the liability issue.


    (You regularly see threads from "miffed" third parties who were happy that the other side had agreed they were to blame only to end up with a 50/50 liability after the insurers got involved and agreed the correct liability)
