CCJ on a statute barred debt

    I think the mean they have received the initial claim forms for a CCJ rather than the actual CCJ being given yet. ;)

    What makes you think it is statute barred.
    If its due to drop off in November, that's when it will be statute barred,
    ie 6 years.
    make the most of it, we are only here for the weekend.

    The default date on your credit file and hence the drop off date has !!!!!!! all to do with when a debt becomes statute barred.

    As above, go to legalbeagles, but you obviously now need to defend on the grounds of SB. It would then be up to them to prove acknowledgement within the 6 year time frame.

    Sixth Anniversary 10 Posts Name Dropper Combo Breaker
    After talking with NDL they advised me to contact the debt collectors solicitors who are working on behalf of them, but to no avail so further advised to contact the DCA directly and this time they were happy to give me start and end dates to the account and default date and last payment made, default 9th November 2009 and last payment made 18th December(I'm not sure if this is correct though and don't recall)

    I personally thought it was SB well before the 9th November(Default date) but the spanner has been thrown in with the last payment. I feel as if i have made a mistake in the SB date and have me.

    I guess now what i'm hoping for is it not too late to contact the solicitors and plead my case and hope for a sympathetic ear and offer a *full and final settlement*, how likely is this to be the case.. I have no savings or assets, i care for my disabled son thus do not receive a wage.. i have nothing of value but have got family who could help with a payment..

    Ps.. is it correct if I do receive a CCJ if it is paid in full within the first 30 days that it will NOT appear on the credit file....?

    Its a very BIG IF on whether the payment date is correct or genuine. DCAs make up convenient ones all them time then fail to prove them.

    If it is correct though, you did make a mistake.

    A CCJ paid within one calender month of the judgement date does not go on your credit file.

    What do you personally think would be the best course of action, follow through with my own beliefs that it is SB and they are trying swindle it, or not run the risk...
  • Can you not check back through online banking? That should show you whether you made a payment on or around 18th December - and if not, when the last payment was made.
