Is there any way to request info from ANPR to see if the same vehicle is in multiples places at the same time?Remember the saying: if it looks too good to be true it almost certainly is.0
-
Doubtful. This kind of back office data is kept for 2 years but collating it would probably be way too costly. I'd think the odds would be pretty low of both vehicles being captured by ANPR at the same time.0

If it's a twenty two year old car I suspect it has quite a few "distinguishing" marks ... can't you locate one of those (or absence thereof) in the photo ?0

Apart from the differences in the way the registration is held on, the differences in the type of towbar, the fact that the one in the pic has a GB sticker on and there aren't any on my car.
I know there are sceptics but I only have to stand up in court and say "I don't think it was my car" and the onus is on the prosecution to prove otherwise. If the one in the pic were identical to mine then, no, I wouldn't have a defence. A magistrate is not able to find on "balance of probabilities" but can only find "beyond reasonable doubt". It's a little more than some rusty screws.
"Distinguishing marks" such as dents and scratches wouldn't do it because one could easily say that they had appeared after the incident or that I had had them repaired in the meantime.0 -
Oh, woo. A whole hour or two's work to change.0

Fantastic defence, as everybody knows there is absolutely no way you can take a GB sticker off a car or unbolt and change the type of tow bar, and the statement from the dock with suitably confused expression on an innocent face saying "I don't think it was my car" is an absolute game changer and trump card, sheer brilliance, I can feel beyond reasonable doubt from here................and I'm in dreamland, best of luck :rotfl: let me know the date and place of your appearance and I will sell tickets And you can use the proceeds to pay your fines, there will be a sell out crowd, I wouldn't miss it for the world.0 -

Unfortunately, the Motoring section of these forums seems to bring out the worst trolls around.
It looks like a few people have assumed that the OP is lying about having sped past the speed camera, and now decided that the OP must be attempting to concoct false evidence to try to back up that lie.
All this without any evidence on their part to back up these assumptions.
Dr. Shoe - please don't take these trolls too personally. Instead treat them as if they were hostile prosecuting lawyers. Try to have a good answer to every comment they come up with. If you can do that, you have a much better chance in court.
Have you got a lawyer yet? If not, it sounds like you need one. Failing that, check if your motor insurance policy includes a legal advice line.If it sticks, force it.
If it breaks, well it wasn't working right anyway.0 -
I don't think anyone thinks Dr Shoe is lying, just that they'll need to provide more substantial evidence in order to clear their name.Apart from the differences in the way the registration is held on, the differences in the type of towbar, the fact that the one in the pic has a GB sticker on and there aren't any on my car.
They are all cosmetic though, and can be changed easily enough by someone wanting to get out of the points. I imagine at least 50% of the people in court contesting a speed camera will say it isn't their car.
Changing the plate will take 10 minutes and maybe £5, a new towbar is maybe an hour and £100, taking a sticker off will take 5 minutes with a hairdryer (the colour might not be a good match depending on age though). If you can prove different trim - like the one in the picture is a different spec or engine, with a different exhaust set-up then you might be able to be more convincing. It's less likely you'll move the exhaust for instance.
It's a good start though, but you need to back it up with more credible evidence - statements that the car was elsewhere, as crime reference number for the suspected cloning (you think someone else is driving around with your plate on - so I hope you've reported it?), side-by-side photos of your car and this car.
The car was probably local, you can probably find it in an afternoon scooting around the estates.0 -
I only have to stand up in court and say "I don't think it was my car" and the onus is on the prosecution to prove otherwise.
That's a very naieve statement.
Your faith in the legal system will be shattered very quickly if you think that that will be sufficient.
I agree 100% with the advice and comments from Herzlos and Ectophile - you need something more substantial.
The GB sticker, rusty screws, and tow-bar are just not enough.0
