    this is because you will have reached the max of 365 days that you can get contribution based ESA


    so he is on contribution based esa at the moment.

    Yes, having a blond moment. Thought he would have been given an income based 'top up' but of course that's only if he is entitled to disability premiums. :)

    However, based on what the OP has said it doesn't sound as if he was eligible for contribution based ESA.

    I must say I find this particular 'rule' weird. If someone is actually eligible for both contribution based and income based can you ask to be changed over to income based?

    i find it odd too, that 2 people on exactly the same income, from the same benefit, can be treated so differently.
    it is because those on costs based COULD have another source of income. but equally , they may not!

    maybe rule out those on costs based unless they prove it is their only income?

    you can 'choose' to move onto income related if you are entitled to colts based. the only reason for an income related top up is if the amount of benefit would be higher if they're only entitlement was to income related.

    the bloke is not fit to work or go to a public workplace (serious nerves) and has no other income.


    even DWP accept a telephone interview with him , pre arranged by letter , instead of a visit to job centre every "x" mths

    Even if some moved from contribution based to income based ESA they would still need to wait 26 weeks before being eligible for a budgeting loan.

    Another options;

    Crisis loans have been replaced by local council lead schemes, check with your local council what options they have, for example in Liverpool they have 'Liverpool Citizen's Support Scheme' which as an urgent means award where white goods can be obtained - normally referrals are via CAB or other referral agents such as food banks.

    no one is saying he is fit to work or doubting his entitlement to the benefit he receives.

    it is purely the fact that he receives contributions based benefit that is causing the issue.
    you cannot choose to change to income related from contributions based, but can receive an income related 'top up' in certain circumstances ( for a partner or if you receive a qualifying disability benefit)

    the contributions rules are in place to enable people that have to stop working due to illness or disability, to receive an entitlement even if they have a working partner or other household income.
    your friend is in the unfortunate position of this being his only income.
    they make rules for the majority though and no matter what rules they made, someone would always be disadvantaged by them.

    even if he could get a budgeting loan, i would still suggest freckle or fragile, because surely getting something free is more economical than paying for it?
