Hi,
I had home serve boiler cover for 4+ years.
In November last year (when it was really cold), my boiler refused to work and I was without any heating and hot water.
I contacted home serve who sent an engineer out to look at it, he was unable to fix it there and then.
After a few days I chased up homeserve as I hadn't heard anything, I was told the engineer was waiting to see if he could get the parts!? A full week later I was told the boiler was beyond economical repair and would be condemned.
Homeserve terms state if the boiler is under 7 years old then they will replace it.
However homeserve claimed that it was 7+ years old because they used the manufactured date and not the sold date........ So I would get no new boiler, they cancelled my contract and that was that. I complained for weeks but they would not budge they were adment that its the mabufactured date and not the purchased date.
I have since had the boiler repaired......
I contacted the financial ombudsmen who agreed with me, they contacted homeserve who admitted fault. The ombudsmen said that homeserve would pay out the cost of a new boiler if I showed them the receipt...... I explained that the boiler was repaired.
The ombudsmen suggested £100 compensation!
I had no heating for two months, homeserve washed there hands with me and they can get away with it for £100. I paid £18 per month for years and feel that when I needed the help the insurance was useless.
Should I take this further? Small claims? They did admit fault to the ombudsmen.
Any comments or advice would be really appreciated

Presumably the FOS instructed them to pay for your repairs as well as the compensation?
Irrespective you can go back to the FOS and appeal the amount of compensation and await the final decision before contemplating court action against homeserve (your only alternative after getting a final decision)
(Then get proper legal advice on your chances at court)0 -

I think if you tried taking this to small claims, it wouldn't even reach the court, as it doesn't have any merit.
FOS have decided in your favour, and you're getting the cost of the boiler repair reimbursed, plus £100.00 compensation for inconvenience and distress.
Did you buy an electrical heater for heating? That would have quickly sorted that issue out, and the FOS would have likely given you that cost reimbursed too.0 -
