Whats the best way to make a personal injury claim?

What is the best way to make a personal injury claim?

I ask this because I was contacted out of the blue by a company called Accident Advice Service about a car accident that my mother and I (I was the driver) was involved in 2 years ago.

To cut a long story short, the other insurance party admitted liability after I made a successful non-fault claim on my own insurance. I was paid the full value of my car at that time.

The said company has passed my details onto a local solicitor who have been contacting me frequently.

The solicitors are "no win no fee" and have told me they take 25% if my claim is successful. They are sending me paperwork next week.

I'm suspicious because they appear to be pressing me and I have seen 2 bad reviews about them. Am I paranoid and should just go with them? Or should I ring round firms or do something else?

    Have a look on the Law Society Personal Injury Panel http://solicitors.lawsociety.org.uk/?Pro=False and choose a couple of local firms that you've heard of. Phone them up and see what they'd take from the compensation - it used to be the case that the better ones didn't take anything and their costs were paid by the other side.

    Of course not, but you can't let that get in the way of a claim. I get at least 1 call a week from a company asking me to put in a claim, I haven't even had an accident.


    Phone enough people and someone is eventually going to say yes they were in an accident, then the scam starts, injuries, bah that's just for the paperwork.

    I now get calls saying that I'm entitled to compensation just because I was in an accident that wasn't my fault. Apparently it's the law :rotfl: Surprise, surprise they can't tell me the name of this mythical "law" :D
  • Seems they struck lucky with their cold calling in that they found someone who had actually had an accident and believed what they were saying. I get a call like this at least once a week. No accidents here.

    Many thanks for your responses. To clear a few things up, it was a very serious car crash but I was not injured. My mother who is severely disabled could have been injured as a result of the accident but am unsure as she has severe osteo-arthritus and has lympodema.

    I was contacted 2 years ago by a firm of solicitors who were affiliated with my insurance company who told me to list all my expense. To be honest we didn't proceed any further as we both had a lot on our plate, but we were informed that we had 7 years to make a claim should we want to.

    The question I posed originally was for my mother. I have no intention of making a personal injury claim for myself. If my mother makes a claim, I want it to be actioned properly.

    I suspect that my insurance company may have sold my details about the accident which is why I received the phone call this week.

    So I would like to further ask, what is meant when a solicitor claims cost from the other side?

    You won't get a payment if you could have been injured, only if you actually have. You say neither have been injured so I dont see how you will get a payout.

    I think you misread it.
    Op wasn't injured,his mother could have been but hard to tell due to pre existing conditions.

    Op not sure your details have been sold on, I get calls like that all the time but hav never had an accident

    Ah yes looks like I did mis read that bit. However problem here is a no win no fee is unlikely to take it on if its not a sure thing to get a payout.
