yup ok , you continue thinking that , PS can I send you a few invoices , red ink and all!0 -
I don't think you are interpreting my messages correctly. I intend on appealing this ticket and following the process. Earlier in this thread I was told I "will lose". That statement insinuates that I don't have a chance to win. That is why I said "I don't want to go down a path that has already been proven to not work." I am seeking advice on this concern.0

NO read again!!!
the comment was that the basic appeal was done via the IPC as opposed to the BPA.
some might say the BPA is fair on there appeals (?)
however the IPC is a scam , run by a company of solicitor's and debt collectors , with the dregs of the PPCs as members , dragged there because of low fees and no code of conduct.
it is not in the IPC interest to allow an appeal , as they are basically crooks.
however if you follow thru with a well worded appeal and you get the usual rebuff , and bull£$%^ , this will stand you good , IF it gets to court.
they will not like the judge studying there system , so stay away from there0 -
Was this Vehicle Control Service Ltd or Vehicle Control Solutions Ltd?
The former is in the IPC whereas the latter is a BPA member.
IPC, you will lose as it's a kangaroo court, but you need to appeal anyway.
BPA, you stand a good chance of winning.
Is this not saying that if I appeal to Vehicle Control Services Ltd. (which is part of the IPC), I will fail? Or are you saying that I should appeal to the BPA somehow? Because the newbies page says I need to appeal to the company, in my case Vehicle Control Services Ltd., not the BPA unless I am mistaken. Do I mail the appeal to the BPA?0 -
appeal to VCS, they will more than likely reject your appeal and allow an IAS appeal within 21 days
you appeal to the IAS , they will more than likely reject your appeal as well
at this point you either pay or ignore anything except an LBC or an MCOL, within 6 years
you then have the right to defend yourself to a judge in small claims court if you decided to ignore everything except court papers , VCS would have to prove they are correct in court, to the judge
this is what I would likely do (all the above)
then its down to an independent human being to decide0 -
Redx, thanks for your advice. I will follow the appeal process through VCS and IAS as you stated and then decide whether I will pay or not when I get to that point down the road. Thanks again.0

No - you can't appeal to the BPA. Vehicle Control Services Ltd is a member of the IPC.
The second stage appeal body for IPC members is IAS and you must first appeal to the parking company who when they refuse your appeal will provide you with a ref no. so you can appeal to the IAS if you wish.
The IAS are considered very biased towards the parking companies and although some appeals have been upheld it is only a small percentage.
No-one can say whether you may be one of the small percentage.
The advice is to appeal 1st to the parking company who most likely will refuse your appeal.
You will then need to decide whether to bother with an IAS appeal. Opinion is divided.
But the chances of a court claim are slim from this company.
The chances of winning a court claim are higher than getting an IAS appeal upheld. Some think higher still if you show you have been reasonable and followed all appeal processes.
EDIT: Apols for the x-over - was drafting response and didn't see Redx had already given you an answer0 -
That's great info. You gave some extra details that Redx didn't mention so it was worth it. Thanks.0
