Can anyone tell me if I still have grounds to continue with this claim or should I just give this one up as I am about to start trying to claim unfair charges from them aswell

I am also claiming from Capital One and also received a letter saying that I was not one of the people who was affected by the misselling of PPI and that I had a cooling off period to cancel. In my case I was not aware that I had taken out PPI as I had done it on the internet back in March 2005. I have now sent them a letter back giving them a valid arguement for each of their points and I am waiting for a reply. I don't know what your circumstances are for the mis selling but if you send me a PM I'll forward a copy of my letter for you to have a look at if you like.

Hi all, I've just spoken to egg regarding a loan i took with them back in 2003.
The guy said I had already had a portion of this money back!
When I repaid the loan 8 months later (40 months early) a % was deducted from the re-payment amount.
I told him this was not mentioned to me at the time and as I had the loan agreement letter infront of me I still wasn't satisfied as the ppi was yes, you guessed it bunndled in with my loan ammount with out a mention of being able to cancel it!
Anyway egg are going to send me the information re; a % of the ppi refunded!
What should I do now? has anyone else had this from egg?
I'm also waiting for Natwest to get back to me!0 -

i took out a 4 year loan last novemebr with northern rock and took out PPI with the loan.
at the time i wasnt aware what mis-selling entailed and its only since reading the great article on martins website that i have noticed that i have been sold a single premium policy
i spoke to northern rock over the phone and asked them if i could cancel the PPI element of the loan, but they said i couldnt unless i cancelled the loan and took out another loan without PPI, which i did not want to do, as its just paying extra interest
i then wrote to northern rock sending martins template letter, explaining that i believe they mis-sold the PPI with my loan
i have now had a reply back, unsurprisingly that believe it has not been mis-sold
can i go to the financial ombudsman with my case
i want to cancel the PPI policy and recieve part or all of my premiums back
what do you think my chances are??

I used your site to try and get a refund of PPI. I wrote to the company that we had the loan with (FIRST PLUS) who in turn bounced us back to the finance company GREENHILL FINANCE from whom we have beeen refuse a refund.We took out a loan in 2001 on the understanding, (over the phone) that it would be for a short term and would want a company that would not bang on a load of charges when we repaind it. They were fully aware of our circimsatnces at the time, as we had had other loans in the previous years, I had had a car accident in 1998 and was due a large payout at any time from that accident and wanted to consolidate our finances to help us throught the waiting as I was no longer working. At no time did they tell us that the PPI would not be refunded if we repaid it early. We repaid the loan in full in 2002. The original loan amount was 42,000 pounds some 8,370. pounds and 60 pence was added on for the PPI We repaid some 53,000 approx back some 12 months later, so surely we should be entitled to some refund?? The loan was over some 300 months.Who do we try and claim from? The finance company or the loan company FIRST PLUS, as these are who we had the agreement with and who we paid the PPI to.Had a fob off letter from both and don't know which way to go next0

I am in a similar situation with First Plus they are currently looking into my claim with them.(and i have got to chase another claim organised by a 3rd party)
I am sure I will get the fob off but I am willing to take my claim to court as I would love my time in court to stand up and ask them to explain themselves.
This cannot go on with them taking consumers money in the way they do and not giving a partial refund or allowing a transfer to a new loan.
i am considering my 2 PPI claims as a savings investment I WILL get back in the next few months - I am not affraid to take it to the top!!
Treaten to take them to court and them get the ball rolling with a court date if they dont take any notice - people power

I sent a second letter to yes car credit/direct auto finance asking for my ppi back. they said they werent fsa authorised at the time i got the car so the ombudsman cant do anything even if i did contact them, is this true?? also ive read elsewhere that the mechanical breakdown insurance they made me take can be claimed back too, can i? Heres the letter thay sent to me below, ive highlighted the bit about fsa at the bottom, any advice on my next step would be much appreciated.

We have set out our position in this matter and have responded to your previous correspondence.
However to clarify the following points raised we would again, confirm as follows:-
1. you have provided no particulars of the conversations, which are alleged to have taken place.
2. you have only raised these issues several years later.
3. you signed documentation stating that the insurance products were optional.
Your position is not supported by evidence. we have no reason to believe that our standard procedures were not followed at the time the agreement was entered into. our position is borne out by the documents signed by you.
It remains your perogative to take whatever action you feel necessary, if you still feel pursuit of a 'claim' is warrented. we have responded to your correspondence and will now close your file. however, please note that this agreement with our company started on 15th october 2003 and therefore, occured before we were FSA authorised. it is our understanding that this therefore falls outside the jurisdiction of the financial ombudsman service.Debt Free Birthday: 25th September 2010 :beer:0 -
Does the reclaiming of PPI include policies taken out on Hire Purchase agreements too, or is it limited just to cash loans?0

Had a Northern Rock loan between 2001 and 2006, just phoned them and asked for a copy of the agreement and insurance documents to be sent to me, I know I had PPI, however in the time I had the loan I was self employed for the last 2 years aswell as employed for the first 3.
I'm going to go with the mis-sold as it was the only way I was going to get approved over the phone.
Do have a Cahoot loan too, applied online, but it seems the box is checked by default on this one, so no chance of claiming it back.The man who removes a mountain begins by carrying away small stones. - Chinese Proverb

Hello,
I've sent a claim letter to nationwide to claim on the basis of mis-selling due to the fact that there was unemployment cover on my ppi and I'm self employed.
nationwide have writen back stating "However I can clarify that you are eligible for all three elements of the cover and the same processes are applied to both self employed and employed customers."
"As with employed customers, to claim against unemployment you would need to have ceased trading and provide proof you were receiving job seekers allowance."
I don't work self employed full time as my work is seasonal and work available is intermittent, therfore it is unpracktical for me to cease trading for a month just to start up again. so I supplement my self employment with casual jobs (on the books) and agency work. do I still have a case for being mis-sold ppi?
