Has anybody had any success with reclaiming based simply on the fact that they were not told about PPI at the time of signing for an agreement?

Having read the success and failure thread, It seems that people who have succeeded have for the most part had a definite provable case (i.e. could prove they had pre-existing medical conditions or can prove they were unemployed etc)

I have a GE money store card with PPI on and a Lloyds CC with PPI on. Both were taken out and signed for many years ago when I did not have a clue about anything financial and I certainly had no conversation about any protection or insurance. Reading the main article on here I can see that this is classed as miss-selling too, but has anyone ever got anywhere with this angle as I guess it's almost impossible to prove things? For example if the PPI box was ticked on the application form, how will I ever prove it was already ticked and not done by me? And if they say they told me about PPI at the time, again it’s their word against mine so it seems pointless to try?

I was certainly never informed of what PPI was and in the case of the GE Money card, I just filled an application form in at the till point so can’t have had any proper advice?

Thanks in advance for any advice,
    DM

I could do with this advice as well as my claims to fit in this category. I'm on second stage letter with the two loan companies, no responses from any of the credit card companies so far. interesting that the cc companies have not reacted in anyway...

  • I was approached through telephone by a legal company offering me assistance to reclaim on my behalf. They sent their representative to my house with a couple of forms for me to sign.Initially they told me that they charge no more than 30% of my compansetion which they will deduct when payments of compansetion have been done. After reading their terms and conditions I discovered that they write of other charges including hourly rates for the time taken to complete case. I have 14 days to cancel contract without any charges to myself. Please help me as to step I should take?

    Morning all,
I'm a newbie to the PPI reclaim forum. I've sent all my letters off to CC companies & 2 loan companies, had a reply from paragon, saying that they were unhappy that I had complained about the PPI, but it was nothing to do with them & I should contact the broker who dealt with the original loan application, and as far as they were concerned that was the end of the matter, any tips as to what I can do now.
    Thanks in advance

Jumping the gun but may be getting somewhere. LTSB complaints MD is coming back to me tomorrow to let me know if he is going to overturn the decision and pay up. Before this happens, and just in case the decision is in my favour, roughly how much should i be looking at to get back.

Loan one was £948 + interest over 12 months
Loan two was £2530 + interest over 60 months.

A rough guide would be appreciated as we know these people are not always the honest souls we would like them to be!

Thanks loads and will keep you updated. if this fails its FOS and then courts all the way!
  • I have just had a letter from my bank refusing a refund for PPL I saw on the agreement that it was optional but this was not explained to me and how much it would cost whenit was taken out.I have also paid it off before time Can someone advise on my next step. Many thanks

After accepting their offer by cheque on friday by phone the lady said they'll put an acceptence form in the post for us to sign.........no sign of it yet:confused: .Surprise ,surprise.Wish they'd hurry up.We have to send it back yet, then they have to do the cheque, then it has to clear in the bank.

have had, what now appears to be, a standardised offer from first plus regarding my ppi. an enhanced (!!!) rebate of 78% of the insurance premium. They are offering 4,125 in addition to 1,229 that will be applied to loan acc on cancellation of the policy. They have worded the acceptance meaning that they will take the whole amount off the loan account rather than a cheque to me and hubby.
Has anyone held out for the full amount of the ppi to be given back/took off the loan (in my case it is over 14,000) as why should we still be paying for something that is useless and we are unable to claim off. also how are people doing with getting their monthly payment reduced by ppi amount?

am really unsure as to hold out and take to fos for full amount rebated or settle now??

Hi, on my agreement it also says 'optional' and l am now on 3rd and final letter because they keep saying no, but my arguement is one signature was required for loan and ppi so l assumed if you cancelled ppi you had to cancel the loan too, and as they know people are proberbly desparate for the loan they know we wont say anything to rock the boat, so thats the arguement lm going with plus not enough info given considering price of ppi etc, alsol quoted 'sale of goods act' and 'misrepresentation act' Hope this helps a bit .
