    Hi my dear MoneySaving peeps,

This is my first posting but I'm religiously following Martin's suggestions for years. We just very succesfully reclaimed remortgaging fees (£110!) and now we decided to move to biggies ie PPI and Council Tax rebanding.
So here is what's our situation with PPI: Back in 1999 and 2000 we had two Barclayloans which we later repaid and, as you can imagine, bined the paperwork. So we sent a later to Barclays begining of February asking for a copies of agreements for all three loans. Barclays just replied saying that they are "unable to provide requested forms due to timescale involved". But they've enclosed copy of statements for each loan which gives details of the amount borrowed, all entries and the closing balance of loans. From those statements I can see that on 11th June 1999 they've given me loan of £2500 and on the same date there's also something called "BIDL GP PPI PREM" of £326.82 with total amount due £2826.82.
There is something similar for second loan from September 2000 - there is amount of loan (£15000) plus something called "Insurance Premium" (£2659.09) with total amount due £17659.09.
Can somebody please help me with this? Do I have a case here? Do you think that I can chase them for both loans and try to claim back both £326.82 and £2659.09 on the base of the statements that they sent me?
Thanks in advance for any tips
    xG

Hi all advice appreciated, Basically years ago I took out a £1000 loan with LTSB with ppi, paid it off with a bigger loan, then another then the one I have now which was for about 5 or 6K I can't even remember the details properly as I was just glad it went through, there is PPI with this loan as well. I work part time and get working and family tax credits and maintanence for my 1st born.
Mt problem is, is my 1st born is off to uni in sept and I will lose about £100 a week as I won't get child tax, family all or maintenance. I'm really going to struggle to make repayments. I briefly enquired at the bank if I could tke longer to pay it off and pay smaller payments, but it was a 'computer says no' moment, he thought it might be cos I have a £500 overdraft which I use to the max every month.
I don't know where to turn, would I be able to switch my loan to another bank like people do with cc's, also would I be able to cancel the PPI.
I'm not very good at this stuff so any advice would be great.
thanks. I pay £156 a month inc PPI

    Hi TUFTY,

Im no expert, but what i've read on here, your local citizens advice will be able to advise you and possibly set up a new repayment plan reducing your outgoings... but wait for everyone else, cos thats what i think and i might be wrong!!

Hi Lisaw thanks for reply, I might have to go to CAB but was trying to avoid that, never know who you might bump into there, lol, I meant to add on my post I'm paying £156 a month and have just noticed on a barclay site that £4K loan repayments are only £79ish without ppi, that's about half what I'm paying.

It's just occured to me, a colleague at work went to CAB as she had debt problems, I think they got her debt repayments cut by half, but then she kept getting phone calls at home and at work from the people that she'd owed, she had to contact CAB again to get them to stop, apparently this happens to a lot of people who have there debts reduced, I'd die if they rang and OH answered as he doesn't know about my loan.

The PPI is definitely a factor, but wouldnt double your payment. There is no shame in CAB ( but know what you mean ) why dont you arrange to speak to someone over the phone in CAB? I am still paying my loan to lloyds via a debt management programme and it brought down my payment from 328 to 130 over a longer term and with no interest. You def need to speak to a professional for guidance, and if you dont want your ppi then cancel it! :-)

They are not allowed to speak to anyone except the account owner. When I did mine, they called, once, maybe tiwce, but apart from that it was all done via letter. After the first few weeks, then dont write anymore. I just get a phonecall once every six months offering me a reduced settlement.

Can someone please tell me,whats the best way to go about obtaining a copy of a Credit Agreement.I have the Company Address and dates the loan was taken out and settled however I don,t have the Account No.

    Thanx for your help

I succesfully obtained a copy of my credit agreement from my provider after I requested an SAR (Subject Access Request). Having read some other posts there can be a £10 fee involved. Send a letter giving them the details you have and they should be able to access their records. In my letter I wrote the following:-

Under the data Protection Act 1998 and the Limitation Act of 1980 you must supply me with this information.

Give it a try and see how they respond. Don't worry if you need to come back and ask any more questions. Happy to help.:D

Also, is there any chance that they could make the outstanding balance of the loan repayabe immediately?

Sorry for all the questions :o

    Hi mummy,

I would write the letter immediately. I should not worry about them attempting to call in the loan. I do not think they would dare.
I am a former Broker, former IFA and former compliance officer, for my sins.

However, I have since seen the light.
  • Hi Peter,

Just one more question, I promise! ;) I was looking at the template letter at the beginning of this thread and I was wondering which reason I should specify for wanting to reclaim? I can't see them taking kindly to me just writing that I think it's unfair!

    Thank you
