  • Advice needed please. I wrote to First Plus on 2nd November. They promised a response by 7th December, then by 7th January and now they say they still haven't managed it but will try and respond by 28th January. They have sent an Ombudsman booklet and said I have the right to contact them now as they haven't replied in time.

    So do I go straight to the Ombudsman or give First Plus a little more time?

    Wondering if you or anyone else can help me again, trying to claim from Barclays for a mis sold PPI along side mortgage, as you are briefley aware I told you my husband is self-employed and always has been, well received a letter this morning(claim going back to 1999) just thought Id fill you in about letter and see what next step would be. They are saying that my husband was covered(you suggested to ask for terms & conditions I have not yet done that coz as you see the insurance company are up in Dublin not at branch but the insurance was still sold in our local branch not sure who to approach now ?) anyway here is some paraghraphs from letter

    I understand that you feel you the mortgage care policy was mis-sold as you were self-employed bla bla bla.........

    I have today spoken to a colleague from Barclays Insurance Dublin and they have confirmed that even though you were self-employed at the time policy was taken out, you were still covered for accident disability and unemployment.

    Bla Bla Bla................................................................................
    A mortgage advisor gives advice and recommendations on insurance policies available and ultimately this is then the customers decision to make an informed choice on the policy that is suitable for their requirements.

    GET THIS - The Mortgage advisor does not discuss the TERMS and CONDITIONS of insurance policies, as at the time of interview with customer the insurance policy is not accepted. If accepted the agreement is made between customer and insurance company.

    They then go on to say that Barclays Insurance Dublin would have sent us terms and conditions I dont remember that as I thought they were on back of policy which I have - no mention of self=employment at all and then they say we would have signed this to agree.

    Bla Bla cancellations rights then get mentioned certain time to cancel

    They go on to finish with - Given all circumstances, I am unable to uphold your complaint about your Insurance Policy was mis-sold

    I am sorry if this is not the outcome you wanted Bla Bla Bla............
    .....They then say I can go on to FOS

    What do you think my next step should be because Im not giving up that easily !!!!! :confused:

    just to let Tiggrae know I havnt used any of the advice you gave me in post 1674 yet bout misrepresentation or aquiring terms & conditions please could you help with next step Thanx again

    What I did state in my template letter to them was that I did not work and was over 65 when I took the loan out, also, that I was under the impression on both occasions that I was told that if I died the loans would be repaid in full but it seems to me that if it happened that way and the reason was anything to do with the heart, then it would not be the case.

    They keep quoting "Lloyds TSB Personal Credit Agreement regulated by the Consumer Credit Act 1974" I can cancel Loan Prot. Ins. and a refund of part of my premium may be paid but an administration fee will apply. If I remain unhappy they can review the decision made using evidence available to them or they'd welcome any new evidence that I'm able to provide and if I wish to escalate this complaint their next step would be to provide a final response.

    Can anyone help me regarding whether I should take this matter further or not, bearing in mind I was retired and my age when I took loans out.

    Reclaiming £1605.82 from HSBC for Graduate Loan Protection on a loan of £17K over 5 years, when the loan went into default the PPI was cancelled and taken off the loan but the premiums that were paid were not refunded.

    At this point (April 2006) we had already been trying unsucessfully to cancel PPI as husband was self employed (in a business) and told it was part of taking out the loan on a basis of no PPI, no loan.

    It's taken Martin's publicity to get this moving from HSBC.

    Husband's business folded and coudn't pay the loan back and it's now being handled by PayPlan and has been for 18 months, that's all fine.

    In Nov, CL Finance BOUGHT the loan from HSBC, all deeds of assignment received saying it had been sold with all rights and ownership.

    Now HSBC want to settle our claim by offering us £1605.82 off the outstanding balance of the loan. We are happy with the sum, but we feel HSBC mis-sold the policy and hubby paid the preminums, now they want to channel the money back into their loan, which he doesn't feel is fair.

    In addition, in November, we requested CCA's for the loan from HSBC, this request has gone ignored, which adds to why we don't want the refund deducted from the loan.

    Husband also has 2 other debts with HSBC which also have CCA request outstanding from November.

    He wants HSBC to give him a cheque, which, upon receipt of the CCA's he will give to Payplan to split pro-rata between all the HSBC debts.

    It was a front loaded PPI loan by the way.

    Any help/advice appreciated

    Hi there, I have a complaint in with the FOS about incorrect mortgage advice received and I submitted it in June 2007! My file has still not been allocated to a caseworker yet. I have called them and they just say that they deal with everything in date order and that they will let me know as soon as it's been allocated. I'm not sure if there are different sections at the FOS that deal with different types of claims, so good luck to you anyway!!

    HII sent my 2nd letter back to the address on their letter..not the original place..i got a reply back from them wihtin a wk.. but still refusing to pay me back....
  • Hi I need sme advcie please. I have a loan with Yorkshire Bank, i sent off the first letter dated 3rd November got a reply saying basically i was told the full terms and condtions and it is no ones fault but my own and that i should not be getting any refund from them. So i worte back usinfg a templkate form here and got a letter this mornign to say that they will not look at the compaint again and that QUOTE" i believe it will serve no purpose to enter into any protracted correspondance on this matter" Whate does this mean??

    Is there any point in going to the Financial Ombudsman. I feel like they have swung it back round and that it was indeed my fault i signed for the PPI..

    Some one please help .Many thanks

    Hi

    About 10 years ago I had a loan from what was the Bank of Scotland and like so many others I took the PPI after being told it would enhance my application.

    The loan was over 5 years with PPI every month alongside the repayment but included in the monthly payment.

    After nearly 18 months I got into difficulty and defaulted on the loan which resulted in me paying a fixed amount through a recovery agency, Blair Oliver and Scott, which I have been paying ever since.

    At the time I defaulted I was told that all the interest would be added to the outstanding balance.

    I contacted them nearly 2 years ago to find out how much I now owed and found to my horror they had added all the PPI charges/payments aswell.

    I tried to contact the BOS to be told that the policy was for the lifetime of the loan and I would have to contact the insurance company.

    I then contacted the insurance company as I had been out sick from work with a bad back for nearly 16 weeks the previous year, but well past the 5 year loan period, who informed me that the policy had expired 4 years since.

    I went back to the BOS who basicly told me tough luck...."We had to pay the policy so we are getting it back from you"

    Sorry about the build-up but my questions are.....

    1. Can I claim a refund from the Bank of Scotland?

    2. Can I claim a refund from the Insurence company?

    3. Can I claim at all?

    I have been through the info pages on claiming but the template letter, I think, does not cover my problem.

    Any help on this would be greafully received.

    does any1 knows what i should do next ..the story is ,i am reclaiming my ppi from loans .co.uk they have told me they r upholding my complaint on the 2nd nov 07 will b in touch takes about 4 weeks ,i have rang and rang them before xmas they told me that ge money will b sending me the payment 4 the full amount of the policy plus 8% interest.
    still havent received anything rang loans last week lady said they will get onto it 4 me i havent had anything this week so rang everyday this week the lady who is dealing with it is off sick, so i asked is there any1 else who can help me they said no its only that 1 person that deals with these complaints....what should i do next ,,not very happy:mad:
