I want to claim back PPI from Goldfish but am unsure of when I started paying. It must be at least 1998

Hi, I am sorry for being a bit thick, But I have a Capital One card that I have p.p.i on, I have had the card for 5 years now, and am now unemployed, I hadnt even thought about using the ppi, and cannot remember at the time if I was told I didnt have to have it from them, Is that and the fact they have already had to pay back money, enough to make my claim? They have paid back 200.00 of my bank charges would that affect this?
Also I intend to cancel my ppi, Should I do this now or wait til the claim comes through??

Hi, ages since my last post as I've been waiting for responses from loan company.
Nothing much happened until I got notification of court date.
That's where it goes horribly wrong...I put it in my reminders on phone and PC but I put it in for October and not September.
Now had papers from defendant showing their defence and I'm guessing that I should have sent my defence documents before now!
My earlier paperwork states I need to send copies of documents I intend to use for my defence to court and defendant at least 28 days before court date, but that time has now passed.
Have I blown it? Or can I still turn up on the day and argue my case based on evidence already sent to court and defendant at the beginning of the case?
Any advice, hopefully it's not too late.........0 -
I have just recived a reply back from Crapital One on reclaiming my ppi charges on my credit card..
It states that they do not belive i have been misold ppi on my account as when i activated the account by telephone customers are asked to hear a ltd version of the terms and condidtions whilst on the phone and the full list would have been sent by post..
in dec 03!! they said i dont fall in the catogary of those missold ppi as these people have already been contacted and action has been taken..
Any adviced from any body would be appriciated..do i just leave it or send a second letter then take it to the FO?

Sent my first templete letter to Freedom Finance reply received quickly telling me we signed the agreement to include PPI therefore we accepted it. Unfortunately all credit agreements were already pre-ticked to include it. We did call them on numerous occasions to say we had not received an agreement without it, I was reassured that one would be sent out. Lone behold a new agreement still pre-ticked, I have all originals and copies which were sent in all about 4-5. I will send another letter however they have said because the loan officer has left (wonder why?) they have been unable to trace the calls with him due tothe system being user specific. Not sure why they can't trace them as I thought under the Date Protection Act they were legally obliged to hold information for 6years. I am getting a little bit stuck however will fight on :mad: .
We only signed the agreement because the loan officer kept calling all the time asking if we had returned the agreement when we said no, he then said we would have to send it back asap because there were going to be changes and did not know if he could get us the loan. We panicked stupidly and signed immediately. (Mugs we were). Will keep you posted with follow up.:wave:0 -

how can we prove that it was misold if we are claiming that they said ppi was compulsory. surely its our word against theirs. took out a joint loan from black horse (part of lloyds) in feb 03. we had told them that we had been refused by two other companies due to our not so brilliant credit rating and feel that they have abused this info. they came back saying we can give you a loan with a monthly repayment of £156 over 5yrs. this figure included ppi. were weren't given a option without. we still went ahead with the loan as we had run out of options. will this still be classed as misold or was it my fault that i didn't ask.

hi. I've had similar reply from Black Horse today. Loan taken out in 02. I've signed legally binding documents, staff claim no malpractise, completely voluntary to take out ppi, had 30 days to opt out blar blar blar! They didnt answer my points properly. They say happy to hear from me if not satisfied and after i can contact ombudsmen.
Any one got suggestions how to make these people realise they are corrupt??

We took out a loan for £33000 in 2001 and with a PPI of over £ 8000. We paid the loan off early (2003) but judging by the amount of over £42000 settled surely we were ripped off. Anyone able to help as to whether I should try to claim and if they have been successful with theirs.

Just recently sent a letter to first plus who stated they had passed the details on to Loans .co.uk who had sold me the policy. Within a week they had replied stating they had no reference of my initial phone call on file and therefore would seek a settlement figure to repay me the policy payments plus interest. will let you know when offer is received. Has anyone had any experience claiming back PPI from Alliance & Leicester yet?
I had a loan with them 2 years ago which I've now paid off in full early, however I had PPI on the loan and believe I was mis-sold as I was told it was compulsary when I applied, and that it was a condition of me being accepted for the loan.
I wrote a few weeks ago now, and had a letter back saying they were looking into it, and a copy of their complaints procedure which says they will resolve the complaint or get back to you to say their investigations are ongoing within 28 days of your original complaint.
It will be the 28th day on Wednesday and I haven't had any further contact from them yet...... Is anyone else in the same position or had a success/failure with A&L yet???0
