    I guess so yeah - I sent the 1st letter saying i wanted an answer within 14 days (they replied within 3) but keep putting me off?

    What do I do next?

    How long have you been waiting in total? The first template letter on here gives them 8 weeks, I'd suggest waiting a bit longer. Have you only sent 1 letter?

    I'm having a bit of luck, but it takes time. My complaint has been in since august.

    As above, has anyone had any luck reclaiming PPI from them. I have had letters going back and forth and they still say it was optional and that I was aware of that. (It was implied that my chances of getting a the loan would be improved by taking it out, and also I had a pre-existing medical condition which I was told 'would be fine').

    They now have offered me the chance to speak to them over the phone or go to the FO.

    Anyone else in this situation?

    I am trying to re-claim the PPI on my MBNA credit card after discovering this site. I have no use for PPI as I have a long term illness that is not covered. I have sucessfully managed to stop the PPI payments (which was an ordeal in itself!:mad: )

    So far I have received a reply from them saying they can only give me details of what I paid from 2001 onwards even though I have been paying PPI from 1999, are they fobbing me off?

    They have also said I agreed to PPI in 1999, I didn't think I had a choice but I know that a few years ago I phoned them to cancel it and basically they railroaded me into staying with it, then I phoned again to cancel and they said they would stop the PPI. But they never did stop it. I have no proof of this so can I still try and get my money back?

    Any help would be much appreciated :confused:

    Hi guys.I posted this last week and am still dithering about what to do.

    "Help. I need clarification about a letter i've received today from First Direct in response to my initial letter advising i think i was mis-sold a policy in 2001.

    I finished the loan in June 2002 when i think i consolidated it and paid it back.
    They disagree that i wasn't advised the PPI was optional as they offer a 30 day cooling off period. And they have said that as the loan was paid back in 2002, i received a partial refund for the remaining term of the loan.

    What i want to know is, can i still write back to them to see if i can reclaim for the year that i did have the PPI as they are saying that as the loan was started over 6 years ago, they are unable to consider a claim. I thought the loan had to finish within 6 years, which it does....just.
    Can anyone advise if this is worth pursuing, or should i file the letter under B.....for BIN.

    please guys i need help they reply to me and they refuse to repay me the ppi !!! what can i do?

    Hi Elsie, see my post above regarding statute of limitation ! However, as you paid off the loan and got a partial refund - the FSA have stated 'no refund or partial refund' terms on PPI policies to be unfair - go onto the FSA website, type in ppi on the search criterial and the 5th or 6th item down is their ruling - I'd think about writing to first direct asking for a full refund as the FSA have stated (copy the FSA document) these terms to be unfair under the Unfair Consumer Contract Term Regulation 1999 - that might just free up the full refund.

    Write back to them saying you believe they have Negligently Misrepresented the facts and under S2(1) of the Misrepresentation Act 1967 the onus is on them to prove otherwise and that if they don't pay up you'll start proceedings within the County Court - see extract of act below.
    • Therefore, under 2(1) of the Misrepresentation Act 1967 provides "Where a person has entered into a contract after a misrepresentation has been made to him by another party thereto and as a result thereof he has suffered loss, then, if the person making the misrepresentation would be liable to damages in respect thereof had the misrepresentation been made fraudulently, that person shall be so liable notwithstanding that the misrepresentation was not made fraudulently unless he proves that he had reasonable ground to believe and did believe up to the time the contract was made that the facts represented were true."

    Hi there, the statutory complaints procedure timescale is actually 8 weeks, they have to acknowledge you complaint, then write back within 4 weeks telling you what is happening with a final response at the end of 8 weeks. Hope that helps
