Problem with vodafone
It's a long story but here go's ! At the end of March my iphone5s stopped reciving signal, so phoned vodafone helpline and they suggested new SIM card , did that it was no better so in need of repair off to apple store ! After trying to fix it they told me a exchange was needed so I said ok , on further examination of my phone it was discovered that my phone had a non apple screen fitted to it ! I was shocked having never foisted a screen or had any sort of repair done ! Apple would not take my phone as an exchange so it was going to cost me new price for a phone ! I got in contact with vodafone who couldn't have been less helpful and after a lot off phone calls eventually phoned apple who said it is vodafone a respond ability ! (Btw can't fault apples customer service !) my last resort is going to the vodafone store where I got the phone from and trying to sort it out ! Been a vodafone customer for 20 years and fed up of it ! I have 8 months left to run on my contract with a worthless phone and am running out of ideas ! Help !

As far as I know it was supposed to be a new phone as per my contract ! When the issues started it was just over a year old 23 days out off warranty ! I would like to think I have grounds to cancel my contract with them ?0

You have grounds for demanding compensation for their fraudulent actions - if this can be proved.
Generally, this has nothing to do with the contract.
I wouldn't be surprised if they try to blame you for breaking the screen and replacing it.
I think Apple must have information on when exactly this phone was manufactured and used first time. Vodafone must have information that it is the same IMEI, i.e. the same handset that they supplied.0 -
Well, if they supplied you with some funny phone instead of the brand new, they have to replace.

Problem is, that's the more reasonable explanation and more likely to be accepted by a court if it went that way. How would the OP be able to prove they never had the phone screen replaced?

The OP should be able to check day of activation themselves on the Apple site.====0 -
