Possible Boundary Dispute

    Possibly, both these things in the general scheme of things are not that important to me, the path is going down to the bottom 3rd of the communal drying green, the top part is easily accessible by the rest of the path. I only noticed it doing my checks on everything. I have asked him to move this but recieved no response. I doubt anyone would back out of a purchase on the basis of a 4 foot stretch of path being fenced off?

    Re the loft, would that really be of huge importance, my flat has a huge basement so storage isn't going to be a problem and it is not something that would be uncovered in searches or anything.

    Never been upstairs so can't confirm but my Dad told me he had surely a buyer would spot this, and either back out or the very least slow the process right down.locked the hatch. I will check next time I am in.

    I am not wanting to make an issue of these things but if it could affect my sale then I may have to. He may regret having started this.:D


    For me if I were looking to buy, the issue wouldn't be what access/land I was loosing but the nutter above me that has claimed them, that would be enough to have me walking away...maybe the best option is leaving it alone, and just hope it's not noticed in the searches and what not.

    Indeed, that would be my worry too. If he accepts that the greenhouse is in my land then I would be willing to leave it at that.

    That loft hatch is something its necessary to sort out - regardless of any storage issues. There might be a time when the next owner of your flat might need access to the loft to check it out because of maintenance issues (ie "Where is that water coming from?"). It's very reassuring to know it's possible to instantly be able to get into a loft and have a good look to see that all is well for oneself. I've been surprised just how many times workmen seem to have to get into a loft to deal with something (eg electrical work/central heating work/the roof itself).

    As it happens we had a water incident 3 weeks ago where I discovered the hall floor was soaking. After much investigation by my plumber we discovered it had come from the shower which had backed up but he had to get upstairs to come over so he could look in the loft.

    Were that hatch open the plumber could have checked right away and that would have saved me an hours time on an emergency call out.

    With respect, how on earth can I be enjoying having a moron costing me money on solicitors, huge amounts of stress and threatening to block a sale just because he wasn't getting his way? Were this on my own property it would be bad enough but having this with my dead father's house is causing me grief and I have not slept in 3 days.

    Yeah, really enjoying this.

    I repeat, I only communicated with his yesterday at the request of my solicitor.

    And that was the only basis I suggested to sell to to him and to move on - not for any other.

    Sometimes "winning" just isn't worth it

    To be honest some of this guys father's behaviours towards my parents over the years hasn't really made me think my Dad would have been particularly pleased for me to have sold it to him anyway. The son's continuing awkwardness towards me certainly seals that opinion.

    Having said that there has been no interest whatsoever in the early days so not sure what to think.

    No, but can only guess that he may have wanted you to be happy and enjoy the money, a sale of his old house would bring?

    The memories you have are with you, not inside the bricks and mortar, its just hard to see that when close to the situation.

    Update: the guy's solcitor made contact with mine today. My solicitor said their one seemed rather embarrassed by having to call them and admitted his client hadn't even measured the plot correctly and until I sent him on my feu disposition didn't even have the plot measurements.

    Makes me feel so much better!

    Another (rather amusing update),

    I had an email from my solicitor today telling me they had come back with different plans to ours with different dimensions. My solicitor sent ou a couple of people to check our plans again and we are still correct.
    So that will rumble on.

    The amusing part is that I received a phone call at 5pm with an offer on the flat. From him. For 10K less than I had turned down before he came out with this boundary "problem".

    How on earth he thinks I will sell it to HIM now for 15K less than valuation and for 11K less than what I turned down from him 3 weeks ago is beyond me.

    It perhaps confirms what I have suspected all along and the "boundary problem" is just a smokescreen to try to bully me into selling it to him cheaply.
  • It does rather doesn't it - ie confirm what he's up to.

    Don't put it past him to try and figure out one or two other ways to be awkward yet before he's through. Though it may be that he quite deliberately offered even less thinking "OP has figured out what I'm up to and mightn't want further aggro from me"...but he turns out to be doing a "paper tiger" on that and its just his latest try-on and he'll finally give up at that point. Fingers crossed...
