UKCPS NtK received but Driver didn't get to see PCN on windscreen

some say yes, in case it goes to court, so you have something to show a judge
others say its a waste of time so ignore everything except an LBC or an MCOL
the choice is yours
Does putting in an appeal & therefore engaging with the PPC increase your chances of ending up at court? If UKCPS only took 800 claims to court last year that seems very low compared to companies like PE.

I guess the point is, last time - with PE - the driver felt the situation was unjust as they were shopping at the associated retail park. This time the driver may not be able to feel the same as there was no such scenario....
So who did the driver cause any loss to by being parked outside an abandoned building in the middle of the night?
Stop over thinking this - same appeal points apply - end of!!!0 -
but some (like myself) would say that the punishment doesnt fit the "crime"
some (like myself) would say that the landowner has lost nothing at all, so as they can only claim back what they have lost (nothing), the amount owed for parking was "nothing"
this is assuming there is a legal contract between the landowner and the PPC
also a legal contract allowing the PPC to take court proceedings out (locus standii)
in other words, say I take my grand daughter to tesco and she was to remove a mars bar unknown to me
is it right to "fine" me £100 for it ?
or just ask me to pay the bill ? (restitution)
should I have my hand chopped off because its classed as stealing ? or just a rap on the knuckles for not keeping my grand daughter under close observation
I may feel bad or guilty about this happening, but that doesnt mean they should give me or the grand daughter a massive fine or prison0 -
If UKCPS only took 800 claims to court last year
but was that 800 court claims , or actual appearances ?

NO , after a decision by the "kageroo club" , the thought of a judge seeing that piece of paper might actually worry them0 -
Thanks. I think the emotive issue of blame was what was holding us back!

It is - PE issued 30,000 -next nearest was Civil Enforcement Ltd with around 3000.
Engaging in the right way, using the right legal arguments probably lessens the chances (obviously no-one can say for sure but....) as it shows your not an easy mark!0 -
If we end up appealing to the IAS are you experts on here able to give support with that as you do with POPLA ones. I'm not sure we are clued up enough to "go it alone".

today, one person won at the IAS because the signage wasnt in favour of the parking company (VCS)
so VCS lost
once in court (last year ?) the judge said the UKCPS signage was "gibberish" and dismissed their claim outright
its the PPC that have to prove the claim, so if you have the correct appeal in place all is not lost, no matter where it ends up
each IAS claim is bespoke, nobody can tell you how to word it, which is why you wont find any templates for them here0 -
some people say not to bother with the IAS appeal as its fixed , however a large paper trail , with a stupid and non legal failure of your appeal will make them look stupid in court.
this is however , my opinion , wait for other remarks0 -

What emotive issue of blame? Stop whipping yourself fgs
Come on Nikabella - you've seen off PE - the most litigious of all the PPC's.
Haven't you learned by now that this whole "skimdustry" is as corrupt as hell!!!!!0
