Rang them this morning without any luck. So going to write a appeal letter.

Use all the appeal points in the NEWBIES template, and add a point that you do have a permit. Attach a copy with your appeal, and ask your Landlord to get this cancelled AS WELL as the appeal.

Appeal as keeper and do not reveal who was driving.

Thanks, what do you mean as keeper not the driver?

Do you mean I should not mention it's a courtesy car?

If you have to appeal as driver (e.g. if yours is a company or hire car) then of course remove the wording about 'not naming the driver' and anything about the POFA 2012 which only protects keepers.

Should I mention POFA 201 or not, because it's my courtesy car? Just got a bit confused here.

I would say you need to see what the Landlords Lease says about parking, otherwise he will have to attend court as a witness as they are threatening court action, depending on the wording of the lease he may have the power to instruct the parking firm to drop the charges as he would be the leaseholder and it is up to him who parks on his land unless the lease instructs otherwise

I would say that the chances of this getting to court are very slim, especially if you appeal and it is refused by an anonymous, far from independent adjudicator.

There is also the question of v.a.t. For this to be a contractual charge, vat must be accounted for, Has it? If they have not charged vat, this becomes a contractual charge, and GPEOL is king.

If you ask for a vat compliant invoice and they refuse, shop'em.
