appeal rejected. Is it worth appealing to IAS

Hello, I appealed my VCN. It's been rejected and I now feel out of my depth. My only option of appeal is through IAS so I am now confused. Is it worth doing it since Beavis case (which they quoted in letter). If so, can you show me the link to assist me. Thank you.

    beavis case is going to be appealed in the SUPREME COURT, bet they didnt tell you that !

    as for IAS appeals, the mix is about 80/20 in the PPC favour , so depends on where it happened, as an airport site is more likely to win than non-airports (any non-relevant land is worth a punt)

    there are no templates for the IAS though, each appeal is bespoke

    Answer = NO.

    Ignore the thing rather than try the IAS 'traffic lawyers' appointed by the IPC. No point.

    Depends which company this was though? Some sue people, some don't.

    I disagree with CM, the decision of the anonymous "Independent" adjudicators, is likely to be so biased in favour of the PPC, so flawed in legal argument, and so divorced from accepted norms of adjudication that the PPC would be out of their minds to let it come in front of a judge.
    You never know how far you can go until you go too far.

    And if it does come before a court, at least you can show you've been reasonable even though the PPC haven!
  • Thanks for your replies but I'm still confused. No they didn't mention it's going to Supreme Court but say it is commercially justified and legitimately enforceable. I was in retail area (when it was shut) and its with VCS. It says I freely entered the agreement and all signs are clear and within accred acne with code of practice. It also says appeals must be submitted within 21 days and discount offer no longer applies. Are you saying ignore and sorry my ignorance but what is LBC and MCOL?

    What is being said is that it is almost 100% certain that the IAS will reject your appeal.

    On that basis, some regulars say "What's the point? Ignore until (or if) you get genuine court papers."

    Other regulars believe that if you show that you took every opportunity to get this settled before court but that, from the IAS rejection letter, there is no "independent" appeal, then the courts will at least not be annoyed that you didn't avail yourself of the full appeal process.

    I am in the latter camp on the grounds that there is no downside I can see to following that route but there are potential upsides.

    Add in that the IAS appeal must cost the IPC and the PPC *something* to reject, thus making their business model less sustainable and the fact it's not binding on yourself either, and there's little reason not to appeal.

    Then when it comes in as rejected you can fire off a complaint to the DVLA (breach of KADOE) and the SRA (because this nonsense comes from a "qualified solicitor or barrister" )about it.

    a few people have tried the SRA route , however without the name of the solicitor/barrister they will not/cannot act , and guess what , the IAS will not disclose there names.

    Then they can name the 2 directors who are SRA registered, or keep complaining anyway and forcing them to act.
