ive told them i was the driver in the appeal stage, am i still on grounds cancel fine

PLEASE HELP,

I received a windscreen fine 9 days ago from CMS (comprehensive management services), I have been reading the Newbies thread and cannot find the answer to my question.
I have filled out an appeal and they have information such as my name, address,email and also have answered yes to being the driver of the car? Am I still on the grounds to appeal, ive been reading all morning but i seem to be going in circles!

Some please help i only have 4 more days within the discount period.

    yes you can still appeal

    but as driver , you have lost POFA 2012 protection

    so any appeal is on legal grounds only, like poor signage , no contract , not a gpeol etc

    the NEWBIES sticky thread does tell you all this

    and its not a fine, wont say that at all, its an invoice that tries to fake its way to looking like a council penalty for similar issues

    but its still an INVOICE , one you can challenge as you dont have all the facts (never seen a contract, the punishment doesnt fit the "crime" , etc)

    the template letter in the newbies thread covers it, all you have to do is ignore POFA 2012 references, because you were daft enough to OUT the driver, at least you wont do so in future ( unless its a hire car/company car/ leased car ? - in which case you should have appealed as keeper)

    Who cares about the discount period? It's irrelevant because no-one here is going to tell you to pay a firm like CMS! Also they are IPC members so appealing (and giving away who was driving) was naive and pointless. DO NOT try the IAS stage, just ignore them now. Repeat - DO NOT try the IAS stage, just ignore it unless you get a Letter before Claim or court papers (unheard of from CMS).

    Just to clarify, I shall not continue with anything from now just ignore unless I get a letter before claim or court papers but this is very unlikely from cms?

    Hello,

    So I've just received an email from CMS stating that they don't accept the grounds to cancel the fine through the appeal I wrote( which is expected). They have said also below that I can appeal through IAS which you have advised not do and also if I choose to do nothing they will bring the debt collectors round etc. I am unsure whether you advise to completely do nothing as I have not done any of the steps on the newbie thread or continue to go through with the steps( except the IAS appeal stage??

    whatever you say, its still not a fine, its an invoice

    no debt collectors will "come round" either (but they may send letters)

    you can appeal to the IAS if the PPC has said you can do so within 21 days

    if you win , thats the end of it

    if you fail, then you can ignore anything except court papers for the next 6 years

    if you can complain to the landowner and demand a cancellation, then do so , as well

    What will a court paper look like? Will they try and send false court papers trying to trick more or is it straight forward? Also more importantly what's the overall cost going to be getting taken to small claims courts generally?

    Though coupon mad said it's very unlikely for CMS to do so

    a debt collector is a timid bloke (or woman) sat behind a computer screen and deciding what colour of ink to use that day.


    "if" you send them a get lost letter (claim with PPC in dispute) , they get nothing .


    so the "we may suggest or the we recommend" our client takes you to court is a bluff (they get no money)

    If they threaten to send round doorstep collectors, tell them that your doorstep is well cemented in so they'll need jack-hammers. :D
