accepted an offer but not heard anything

I accepted an offer for my property and got an email from the EA with memorandum of salewith buyer and seller details and solicitor details. That was two weeks ago and I've had no contact since. I haven't signed anything. Is this usual? Can I pull out if I change my mind?

    Have you considered picking up the phone and calling your EA or solicitor for an update on proceedings?

    Are you buying somewhere? Is the chain complete? Or is everyone waiting for a complete chain before moving forward?

    You say you haven't signed anything... not even an instruction letter for your solicitor? They won't be doing anything if you haven't instructed them.

    I am not buying anything, I have not signed a contract with EA and have heard nothing from the solicitor they have put on the memorandum. So if the solicitor needs my signed instructions before doing anything I don't know what's the hold up. Can I pull out if I am having doubts?
  • I'm on the other side of the coin, we had our offer accepted a fortnight ago and we haven't even received a paper copy of the acceptance (we got an emailed version on Friday)

    We accepted the offer on our property 4 weeks ago today, we had the memo of sale two days later and the paperwork from the solicitors 2 days after that, we filled it in and sent it back, the following Monday we (apparently) had the survey done, since then we've heard nothing.

    Have you filled in all the paperwork from your solicitors? It's unlikely the buyers will progress if your solicitors aren't even communicating yet.

    If you have signed nothing with the EA how have they had the authority to sell your house?

    Has the EA named a solicitor for you or have you selected a solicitor to use?

    You really need to speak to the EA and find out what they are doing as reading your posts don't make a lot of sense to me, but I suspect nothing is happening as the seller and their solicitor generally start things off.

    We had our offer accepted on a house 3 weeks ago today and our solicitor has not received written acceptance! I was speaking to our solicitor at end of last week and he did say he would have normally had it by now. He did say some solicitors like to package up lots of paperwork and send it all in the one so that makes it a bit longer.

    He is going to get back onto them today.

    We accepted an offer on our house 3 and a half weeks ago today, our buyers have got their mortgage offer at end of last week and our solicitor reckons they will be concluding missives on our sale this week!

    You, or any party, can pull out up to the point of exchange of contracts. Once you have exchanged, this is legally binding and you cannot pull out.

    It does not sound as though you are anywhere near exchange, and in that case you can pull out.

    It doesn't sound as if the OP has instructed their own solicitor. In which case nothing much is going to happen.
    OP if you are having doubts then today is the right time to pull out. Think of your buyer. They will possibly have already spent money. And either way, do the right thing.

    The main thing you need to do is decide whether you want to sell your flat.

    If you don't, phone the EA and tell them (but see my final para below).

    If you do, the main thing you need to do is instruct a solicitor (assuming the buyer still wants to go ahead).


    You will have almost certainly entered into a verbal contract with the EA. I suspect they gave you a copy of their terms and conditions, possibly when they looked around your flat. You will have implicitly agreed to those t&cs.

    If the contract is 'no sale. no fee', and there are no withdrawal fees - you can back out without any costs.

    If the contract talks about 'introducing a ready, willing and able buyer', you might have to pay the EA their full fee. (You should always read an EA's contract thoroughly before letting them market your property!)



    If you have a 'ready, willing and able' contract, and you now don't want to sell - some people might argue that you should not contact the EA, but instead persuade/annoy/scare the buyers into walking away. (But whether that's fair/moral towards the buyers is another question.)

    The EA chose my solicitor as they were going to extend the lease for the new buyer. I haven't heard from the solicitor at all yet.
