    General wear and tear isn't covered so in an older car the warranty is sometimes pointless as they use the wear and tear excuse.


    S75 is jointly liable yes, but if it's wear and tear neither are liable so take the age and mileage into consideration, if it's older things are going to start going wrong.

    a rare car and no problems dont really equate
    im sure no dealer would really give an open warranty that any old toad could repair any fault and he would reimburse
    OP you really need to get this rare car properly inspected before you take it 450 miles away from seller and that will cost too

    Yes - you will have section 75 protection, if you paid the deposit by credit card. Section 75 makes the credit card company jointly liable for breach of contract and misrepresentation.

    So if the car dealer breaches the contract, you can either claim from (or 'fight') the car dealer or claim from (or 'fight') the CC company.

    The arguments will not be about s75 cover, they will be about whether a breach of contract occurred.

    For example, if the clutch fails after 2 months - the car dealer may argue that it's not covered by the warranty. If it's not covered by the warranty, neither the car dealer or the CC company will pay out.

    If it is covered by the warranty, you can claim from either the car dealer of the cc company.

    But remember that CC companies don't like giving away money, so you will need to provide lots of proof etc.

    (Section 75 protection won't make a rubbishy warranty with lots of exclusions into a better warranty!)
