Used Car + Section 75

Hi All,

I'm picking up a used car next week and have paid the £250 deposit on my card with view to pay the outstanding balance in a bank transfer.

I'm getting a 3 month warranty on the car, but the dealer is 450 miles away from me. If he breaks his vow to honour the warranty and the car fails in the 3 months, would i be covered under section 75?

    Dont forget to get them to honour any warranty you need to take the car back to them.

    The actual situation will vary a lot and the section 75 may not protect you.

    Cars have lots of parts that wear out in time so its not quite a clean cut case of something broke. You need to ask the question that if you had it from new could it have broken as a similar age or mileage?

    General wear and tear can be used for many faults.

    If you need to take it back for repair what will it cost you? Find one closer?

    The guy has said on the phone that he will pay for any repairs, and ill get him to write something to that effect before I seal the deal, but still concerned incase he backs out.


    The little things don't bother me (up to say a few hundred) but if the clutch fails or timing chain goes then Its possibly £1k plus.

    Cant find one closer as its a rare car to start with :-)

    I suspect neither, and I'd be very surprised if he'll let you take it somewhere closer to home for repairs and then pick up the tab!


    I think you'll be disappointed to find out later that section 75 doesn't apply.

    Buying the car with a 3 month warranty, and why wouldn't section 75 apply, can you please explain?

    Normally warranty means repairs by the seller or the manufacturer.
    In your case it has to say very clearly that repairs can be done by third parties, that the costs will be reimbursed and what faults are covered or what faults are excluded. Possibly, about the mileage as well.

    Not "something to that effect".

    I'll be getting something that would stand up if questioned by a local court.

    Still no info on if I'll be covered by section 75 yet though

    If it would stand in a court, I don't see why it can be not good enough for s75 claim as essentially you can sue either the seller or the CC company.

    Unless there's a lawyer specialising in section 75 on here you won't do. All you'll ever get on here is opinion.

    So, why not consult:

    The Act itself?
    The Financial Ombudsman?
    Your credit card provider?

    And come back and let us know what they each say.

    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    450 miles away, I'm assuming its an extremely rare classic or something.

    Please don't say Ford Mondeo

    No 2nd hand car warranties are worth the paper they're written on, unless its a main dealer extended warranty. Even then you'll need to prove it isn't wear and tear.
