Defects In New House (Legal Position)

Options
I have moved into a new property approx 6 weeks aga which was built by Bryant Homes. They were subsequently bought out and are now Taylor Wimpey.
Part of the post move in package was a walkround with a Customer Services member to look at defects but this has not happened, Bryant Homes were to carry it out after 7 days but Taylor Wimpey do it after 30 days. We are now past both dates, and nothing.
I have contacted the Taylor Wimpey Customer Sevices Manager on numerous occasions and have been informed that defects will de dealt with as a 'matter of priority' but again, nothing.
The defects I have informed them of are:
1. Tile fallen off roof to front of house (danger with 3 children) and hole now left in roof (water ingress?)
2. Drainpipe at rear of house misaligned letting water run outside of pipe and onto house wall leaving large are of damp.
These are my 2 main areas of concern along with hot water problems (electrician saying it is a plumming problem and plummer saying it is a electrical problem), along with approx 10 minor problems.
Can anyone advise where I stand legally? I have numerous e-mails sent to them and even the sales rep at the development has tried to get things done but nothing. I am prepared to go to a solicitor if it will get things moving but hope that a properly worded letter will help. I have informed them that I am going to Trading Standards but that obviously didn't work.
Will the NHBC agreement help me?
Any help appreciated as I am totally frustrated.

  • Hi guys,
Sorry to do this but bumping:confused:

Am I on the wrong board or just unlucky as I hoped there would be someone that could help. I just need a way forward such as a website that point me in the right direction, anything.

I am desperate and would really appreciate anything that can aid my plight.

    Yours in anticipation and desperation

there was a dispatched programme the other night that said the NHBC are employed by the Homebuilders.... and easily swayed in the favour of the builders.

I work for a solicitor but I am only a clerk so don't take my word as gospel will you.

Write them a letter yourself, saying that you want these problems fixed and that time is of the essence. Send it recorded. Mention that unless you hear in 7 days you will be consulting a solicitor. You should get a free half hour from the place that did your conveyance as you are a client of theirs (that is what we do) They might, depending on the solicitor, fire you off a warning letter free of charge, like I say depends on the solicitor, our old senior partner would have done he hated seeing his clients ripped off (I know you may laugh...)

    Good luck !!
  • Thanks sallyrsm,
    much appreciated advice.
I believe that I have sent numerous e-mails to them threatening to go to a solicitor so it now seems my only option. I even sent an e-mail using their customer services link on the website but nothing back. Thye have a 'customer feedback' percentage of %76 in relation to house buying which to me seems a joke.

Off to solicitors I suppose ( and get my NHBC doc).

    aarrgghhhhh:mad:
