Buying house & land clause query

    Your options as already stated:

    * Buy it and keep it as an investment. If anyone parks a caravan or similar there, you evict as trespassers - fairly straightforward.

    * Buy it, sell it on with a covenant. If anyone parks a caravan or similar there, youenforce the covenant. Slow, stressfull, potentially expensive.

    * Buy the house but not the land and keep your fingers crossed. If the worst happens, it will be a nightmare

    * Find another property.

    ps - ignore anything the estate agent says. He just wants to reassure you so the sale proceeds, his client gets the sale, and he gets his commisssion. Remember, he is not your agent, he is the seller's agent.

    Thanks a lot for the replies.

    One other question instead of opening a new thread, I mentioned that the travellers are in appeal stage for their right to live on the land however it transpires (having read the documents in full) that the appeal was actually rejected as it was 'out of time' i.e. the council received the letter 5 days too late.

    I am not sure if this is a delaying tactic, although I doubt it's just oversight on their part somehow. Is this the way that travellers supposed work the system or will they actually be thrown off the land now?

    Edit: Having Googled it, it appears councils rarely bother to actually undertake enforcement action. Think I'll walk away then. Thanks all.

    courts and councils have discretion to allow 'out of time' appeals/responses etc, and fairly often excercise this discretion.

    As you've said, councils seem reluctant to take enforcement action, and when they do it becomes a political hot potato.

    Is it possible to see if the local council are going to evict them, Ie can I speak to the enforcement officers ? Or will they cite "data protekshun" and not divulge anything.

    I doubt they would put anything in writing, but a friendly chat wih the Planners? Who knows what they might say 'off the record'.

    If you cannot buy the land, then run for the hills!!


    The council that took action against Dale Farm are in a minority and even now it is not resolved.


    The council adjacent have allowed 'illegal' sites to continue.

    agreed, I'm just talking figuratively now. There are so many travellers round here it's good to be prepared.

    If you bought this land it could provide some income - renting it as grazing land or for making hay or silage. As has been said the only way of controlling your outlook is owning the land.
