Thank you all for your constructive advice. I don't understand why this issue is so unclear and how, being such a contentious topic, that it has not been properly tackled by the law. Someone made a valid point on another thread that if you overstayed a night at a hotel, you wouldn't expect to pay more than the extra night's accommodation. Another person responded by saying that they could effectively charge what they liked as long as the contract was displayed, but if this is the case, then why have the government tackled 'loan sharks' and restricted the interest that they charge?
£100, and in some cases, £200 fine is not reasonable for occupying a car space! I do agree that there has to be some incentive for people not to blatantly abuse the system of car parking, but the ticket machines are effectively an honestly box! If the car parking companies want to ensure payment is received, then they should all be barrier operated or at least have attendants that inform people as they leave the car and at least give them a chance to pay the ticket. Why don't Trading Standards get involved with this extortion?0 -
PS. I am going to try to appeal to the landowner first, as I am fairly local and I am hoping that he will see that it was a genuine mistake. He sounds reasonable. Does anyone know the relationship between the owner of the pier (Mr Christou?) and the parking company? If I were Mr Christou, I would be really concerned about how this company are representing his business.0

Well, the landowner probably appointed the PPC!
Just why should the landowner, however reasonable, make an exception for you and not everyone else? If he felt there was a reason for employing a PPC - maybe he gets a bit of the take - then it was probably because people were not paying the ticket price.
I would follow the advice of the sticky and wait for the NtK and then appeal, but not using the "Sorry I didn't know" mitigation. Instead, why not, as you are local, check the signs and the wording on the PCN and NtK when it arrived for 100% compliance with POFA?

Shall I take the landowners time up and threaten them that they will lose business because of my mistake....", "shall I deliberately attempt to put people out of work, and quash a legal and binding contract, because I got a parking ticket"....Good point Guys Dad - I salute your common sense. Heres a BAD idea pocketmolly - pay an appeals company some money for them not to do any work on your behalf, listen to the regulars on here (who, with Mr Beavis) lost in the court of appeals and have now given all the parking companies an opportunity to justifiably pursue you through the small claims court. Or maybe common sense will prevail.......0

Beavis IS going to the Supreme Court with RAC and Consumers Association. So your comments are a bit premature.
And in any case, the application of the case to a particular set of circumstances will depend on what a judge says.
@PocketMolly and others. Wait for Notice to Keeper and decide then if you need to appeal. In the meantime get onto whoever hired them as they are in the frame for the refund. The PPC won't be about and won't repay these monies - so you'd best let them know there is nothing "free" in the parking world.This is a system account and does not represent a real person. And did Bazster not advocate the appeals services run by his 'friends' last year - The Parking Ticket Appeals? I feel now Barry and his mates have had their air time - and failed thus far - the likes of APS Ltd and others now have a genuine reason to change attitude and indeed go down the court route......Why wouldn't they? Unless I am mistaken, and from the horses mouth, county court judges are not only far to busy to deal with parking issues but more importantly, swaying ever so slightly away from the poor, uneducated and unfairly treated motorists - and more inclined to listen to their superior judges opinion. The RAC and the Consumer Association are already left licking wounds.....why do you presume the case will go in the motorists favour this time? The regulars on here were convinced last time.....so much for their knowledge.0
