    Something can be described as 'oh so boho' and still be from Primark. The crux of the matter is what label, if any, the dress was sold as.

    Primark would be either 'Atmosphere' or 'Denim Co', although they do ocassionally use a different label. Obviously a seller doesn't have to list the label or shop if they don't want to and it would be up to the buyer to ask. I'm not sure from your response if this particular dress is being sold with a label or without a label but would say that if the actual make on the label is important to someone then they should really only buy from that shop or from someone who has not previously traded in 'second hand/second quality stock where the labels are removed.

    To reiterate, if an auction says 'River Island' (insert whatever appropriate label here) dress and turns up with a Primark label then that auction should be reported to ebay. If the auction says 'like River Island' and states that label has been removed then they are obviously selling a look alike. If however the auction claims both 'River Island' and label removed you would need to check what that seller routinely sells to decide whether or not you think they are selling the genuine article. IF it is the latter and you believe the dress is a look alike you would have to prove it.

    Sorry for following up my own post but a quick browse on completed ebay listings does show one seller listing items as boho and with the words 'Monsoon' and 'Topshop' in the auction title. However no label is claimed and where the auction specifics allows a label name to be included it has been left blank.

    There is another seller who is also listing as very boho, and very chic but has also left the auction specific field blank.

    ACtually the more i look the more I find, and yes I've recognised a few High street clothes amongst the branded clothes.

    It does seem that unless the item specifically claims to have a 'xxx' label then you are buying a copy.

    Without actually VIEWING the auction listing then no one can give an honest opinion.

    When you buy anything off eBay its Caveat Emptor all the way. The only way to be certain of anything is either buy from a High street retailer or an actual company who allow returns.

    My only little niggle is what about if in the description part at the top of listing, the seller put "Oh so Boho" in the label part?

    Come on OP give us the auction number!

    Hi

    Spoke to my friend this morning and sh'e really unhappy.
    The dress is definitely advertised as brand 'so boho'
    She got the dress this morning and it's an atmoshpere dress thus from primark.
    The cheeky girl didn't even bother to disguise the labels and also sent her a bag (as some sort of bribe, one can presume).
    So she has mis described the dress, if she had said label atmosphere my mate wouldn't have bid on it, let alone pay £35 for a £6 dress.
    She has emailed her demanding a refund of everything including her return costs.
    Do youe think she can report the seller too?

    I'm still not clear if the item specific actually said that the label was 'so boho' or whether that was used just as an expression (brand new so boho) Like I said in my first response I have never heard of a label 'so boho'. If there is a label called 'so boho' and you can prove that a dress from there would retail at considerably more than an atmosphere dress you might have a claim for a misleading auction. If however your friend is just peeved that she has paid over the odds for a dress then there is really not a lot that she can do.

    The fact that the auction didn't state that it was labelled 'atmosphere' doesn't mean the auction was misleading. If there is any element of doubt in a buyers mind they should use the 'ask seller a question'option before bidding.

    Unless the seller actually claimed the dress was a particular label your friend doesn't really have cause for complaint. She can try complaining to ebay but on what grounds, buyers remorse?

    There is always the chance that the seller will refund as a goodwill gesture, but that would really depend on the tone of the email that your friend sent to them.

    Sorry, I'm getting really bad at following up my own posts. I just did a Google search for the dress label 'so boho' and nothing has turned up.

    However what is interesting is that one of the first Google options takes you back to ebay where lots of items are being sold as 'so boho' using it as an expression as I have already suggested.

    Oh yes and there is a Primark dress amongst the listings with a current price of £26 but with the item specific entry for brand left blank.

    At the risk of sounding an "*rse" i belive that "oh so boho" is a description of a style rather than a label.

    And having looked at the dress yes.. its look can be described as "oh so boho".
