what to do?buyer mis-describing goods.

My mate has just purchased a dress of an ebayer who sells clothes from 'topshop', 'river island' and 'karen millen' but they are really from a budget department shop.
Anyway she fell in love it and because the seller claimed it was new with tags by 'so boho' she took a chance and paid a whopping £35 for it.
She's awaiting the delivery.
I have since gone into P****** and seen the same dress for £6, told my mate she's stormed down to check and is now fuming!!
When the dress arrives(providing it has been misdescribed) what can she do?

    Did the seller specifically claim the goods were on sale in topshop, river island or karen millen?

    If not, and assuming the goods described as "New with tags by So Boho" were received, there's not much they can do really.

    The goods as described will have been received.

    Buying Primark goods and selling on at a profit is common practice on EBayand not in breach of any rules that know of. :confused:

    I have to agree 100% with Tojo. Selling something as 'like' River Island or whatever isn't the same as selling it 'as' River Island.

    Primark are well known for carrying exact copies of the other shops clothes, they were recently fined for selling an £11 skirt that was an exact replica of a £45 Monsoon one, it even had the same colour stitching.

    If you want to pm either me or Tojo with the auction number we can let you know what we think. If however the dress was sold specifically as a 'River Island' or whatever, then she would have a good case for putting in a claim for item not as described.

    Check the small print of the auction, there are even item specific bits for clothes where the make can be added if it isn't in the main body of the text.

    I have learnt the hard way ...to assume the worst!

    If its brand new like so and so...its a cheap imitation.....

    if its brand new with tags from next...then its probably red dotted (from sale or the next again shops).

    I aways go through listings with a fine tooth comb.... not much advice from me!
    Sorry...but I would feel gutted if it was me.

    But then if I lived near Primark I would shop there and not on ebay!!

    You've come across these ebayers as well have you.
    Bought a top from them for my daughter last september - sent 3 replacements but eventually refunded my money. Paid about £30.00 and it wasn't worth £3.00 - extremely poorly made told them "it looked like it came from the reject bin" which it probably did.

    I think that your friend should be more careful before she placeing any bids. Like check River Island online shop for the price, keep in mind that it's can be 'Sale' time, or even tags could be put in place after wearing it for a week. I hear many stories about people abusing M&S refund policy till they changed it recently. Sorry that your friend had to learn that way, I do understand her. Try to return it!!!

    The OP is saying that the buyer bought a dress off eBay for £35, only later they found out it was really from Primark for £6. Try to return it to Primark and get a £6 refund when you've paid £35 for it?? Hmmm...I don't think so!

    Buyer's remorse maybe...
