Virgin Media contract

I was with Telewest before Virgin Media took over and have to say they were excellent, unfortunately I cannot say the same for VM.
In June I re negotiated my package band I received a letter from VM informing me that my new 12mth contract had just started.
I phoned them today to complain about the slow connection speeds.
I pay £35 for XL broadband I also mentioned that I had never actually signed a new contract, and infact I do not even recall any mention of a new contract when I renegotiated my package.
Do I have any rights to challenge them?
I want to change provider as every month my broadband is capped, yes I am a high user but I am paying for the service which I do not feel that I am gettting since they brought in there new terms and conditions re capping.

When you re-negotiated did you change your package at all? Because any change in package will mean they commit you to a new term. You dont need to sign anything to be legally bound to it.
As for slow connection speeds, do you know if your area has been upgraded to 20mb yet? When my connection was awaiting being upgraded it had a bit of an up & down moment in terms of speed.
Also remember if you're downloading over 3-4gb in peak time (4pm-Midnight i think), then VM will put your connection to 5mb during this period, i.e. traffic shaping

Yes I did change my package slightly so it seems that I will be stuck with VM until next June.
We are still on the 10mb and awaiting upgrading, it certainly is a bit more down than up, all I can hope for is that things will improve once the upgrade takes place0
