Put a claim in to Cap One for mis sell, you were not aware that you could not make a claim on the Insurance and have only found out now when trying to make a claim.
Doesn't sound like a missale to me. They can't be expected to know whether the OP is paying NICs or not. The policy summary would have stated that the holder needs to be signed on at the job centre to claim on the unemployment cover. It's not their fault the job centre won't allow the OP to sign on. It's an unfortunate sequence of events but the solution is not to go throwing frivolous complaints around left, right and centre. There's too much of that happening at the moment as it is.
As I said earlier, best course of action would be to ask AXA nicely is they are willing to refund the premiums since it turns out that the OP could not have claimed on the unemployment cover.0 -
Hi thanks for all your reply, Ive been to the jobcentre and sign on but unfortunately after checking my NI contributions I didn't pay for the last 2 years as I wasnt earning much. When I took the Ppi I was working partime only. I wasn't aware that you have to pay NI before you can claim the unemployment insurance. No one advice me. We did try to escalate the complain at AXA but the second time they did turn me down and said there's nothing they can do about it as I am not entitle in any claim.
Can you clarify how many hours "part time" entails? Whilst my comments above hold true, if you were working so few hours that. you were not eligible for the policy (usually under 16) then THAT would constitute grounds for misselling complaint.0 -

No one ever mentioned anything about NI contributions when you claiming unemployment cover only found out when I rang them to tell them I lost my job recently due to company closure.0 -

If the OP was provided with a policy summary which states that you need to be signing on with the job centre to claim for unemployment and has not read it, that is not misselling. The information was (presumably) provided fully and accurately. Misselling occurs where someone is misled or misinformed about the product and its features, or advised badly to take out a product that is not suitable for them.

To clarify. If the OP was eligible for the product, working enough hours had their eligibility checked in terms of hours working, was provided the policy summary, took the product in good faith and could not claim as the job centre would not allow him/her to sign on then that is not the fault of the seller. It's unfortunate but not misselling. The seller can't be expected to know the OP's NIC history. If, however, the OP was working less than the required number of hours per week to be eligible then that should have been checked and would constitute grounds for complaint.That is what I asked.

That's because it's the job centre that requires you to have paid a minimum amount of NICs, not the insurer. They only require you to be registered with the job centre. However, as you were only working 14 hours per week you would appear not to have been eligible to start with. I suggest you check this with the insurer. If it is indeed the case then you do have grounds for complaint and should take it up with Capital One, not AXA.0 -
The insurer said that I need to pay NI contributions to be eligible to claim the unemployment cover. You ask if I did sign on the job centre and, yes I am. But unfortunately since i didn't pay any NI contributions I cant claim jobs seekers allowance too. So I didn't attend my appointment after knowing that I wasn't allowed to claim the benefits. No one told me that you need to sign on at the jobcentre just to claim the unemployment cover. I took the Ppi incase I loose my job I am covered for any claim and giving me peace of mind. When I took the card I was only working 14 hrs and yet still they provide the insurance for me without asking my job circumstances. Should I take the complaint further as they can't help me at all twice I rang them.
