DWP don't want be on JSA but on ESA

By the sounds of it i will be moving back to ESA as they won't allow me to go onto JSA until the current fit note ends as they said it is due to support group (It is a 3 years one).
They said they are going to send out the PW1's after they found the emails i sent ages ago.
They know that they are impossible for me to fill fully out due to only expenses being paid so said skip thoes parts that talk about paychecks.
It appers like they are treating it like it never ended (From some people higher up at the DWP). So that could be intrasting as they said on the phone the payments are going to be strange for next few weeks then it will be back to every 2 weeks.
Strange that JCP or DWP won't allow me onto JSA even tho they like to get people into work?

In principle, they could be treating it as an official error that they did not send out the permitted work form initially.
How much have you been working?

You can of course simply end your ESA claim at any time. This is probably not a good idea, you can work-seek on ESA.

1 to 3 hours per week.

They won't allow me onto jsa untill at least the fit note ends (36 months fit note).

You do know you can look for work while on ESA I dont see why you would want to go back on JSA to be honest, Have you ever been for a medical during your ESA period.

You can look for work and if you get work just call ESA and tell them to close your claim, Simple. But if a doctor signed you off for 3 years then they must think your to ill to work.

This doesn't make sense, a fit note can only be issued for a maximum of three months.

I'm not an expert but I believe the three month referred to is during an initial period - I'm sure I read about this the other day.

No, a fit note can only be issued for three months in any circumstances - it used to be six months but that was shortened. Aside from that the fit note shouldn't even be relevant once a claimant is placed in a group.

Something is not right, either an admin mess up or the OP has misunderstood.

In the first six months of a patient’s condition, a fit note can cover a maximum of three months. If a condition has lasted longer than six months, a fit note can be for any clinically appropriate period up to ‘an indefinite period’.

I'm really confused:

I thought that a) your fit note could only last for 3 months and b) you could sign off ESA at any time and claim JSA, regardless of the outcome of your ESA assessment.

Peoples situations change and whilst you may be recommended ESA support group for 3 years, (example) the DWP accept that during that time, you may undergo surgery or whatever which may change your situation and mean you could actually work.

From reading the OP mtwiscool is in the Support Group for 3 years, although it doesn't say when that period started. There is therefore no requirement for medical certificates / fit notes. As they are only working 2 or 3 hours per week, even if they were being paid, it makes sense to remain on ESA as they will receive higher payment than if they moved to JSA and there won't be the commitment to spend all week looking for work, attending training etc.
There is nothing to stop people in the Support Group seeking work, and assistance in finding work, but there is no compulsion.
Unless the change has been kept very quiet, the 3 month rule only applies during the first 6 months.
