sorry to ask again , the OP said he told the truth about saying he had applied for jobseekers , they were happy at that point . and he did not lie, even if jobseekers is turned down , you should get DHSS payments , if because of some quirk you don,t they still pay your national insurance therefore you are eligible for medical help.

I also think the rehab would have been NHS based , therefore he is in "the system"

the NHS dental service allows more than just jobseekers to apply for free treatment
  • Thanks for all your replies. You're right, they seem to keep adding money to the amount outstanding and it's the Business Services Dept that issue the letters. They'll seek to recover the cash through CCJ.
In the email he explained all about rehab, turned down for benefits. He currently has to sign on every fortnight to get his stamp paid.
Seemingly, while he was running his own business up until a couple of years ago, NI wasn't paid, so the reason to refuse benefits now is due to gaps in NI contributions.
In the email, he also agreed to complete any income and expenditure forms they wished, as he has zero income and expenditure!
Technically he has no cash to offer them, so he made it clear that it would be me funding the offer of payment -agreed, he needs to ring them on Monday. Likewise, I'll get copies of the email correspondence and send it to them recorded delivery. As you say, if it ends up in court, we can prove that we've pro-actively tried to resolve this.
Why do these flipping letters always arrive at weekends, when you can't do anything about it?

The judge will grant a CCJ for this. The only valid defence is that you did not make a false declaration - and that is not the case here (ignorance is not a valid defence). Also worth noting that these cases can (and have) resulted in criminal prosecution - this is not something to take lightly.

no the OPs other half told the truth , he had applied for jobseekers , he has not made a false claim
  • Enfield Freddy-the rehab was carried out by a substance misuse organisation in North Wales, but he had to have a lot of blood tests and also drugs to help the detox, so this will all be in his medical records and can be evidenced if we need to.

they are wrong to decline and ask for money,

he told the truth , he applied for jobseekers , was refused payments , but has to sign on and they pay his stamp.

The form asks if you are in receipt of income based JSA - this was not the case.

You don't get 'DHSS payments' if you do not qualify for a named benefit.

A credits only claim does not qualify you for help with NHS costs.

There is help for people on low incomes, but that cannot be applied for after the event.

OP, you're doing the right thing, you just need to be more proactive in communicating with them.

I'm sorry ef, but do you know anything about benefit entitlement or help with health costs? You're trying to be helpful but all you're giving is false hope.

I will back down , never having been in a position of income based jobseekers ,
  • Thanks everyone, just wish he'd let me pay for his treatment when he went to the dentist-just as I pay for everything anyway, he thought this would be ok, due to the claim being processed.
Ironically I now have free treatment due to pregnancy.
How would him having a CCJ affect me? He's on the electoral roll as living with me, but everything is in my name, mortgage/utility bills etc.
I'm so worried about bailiffs taking my possessions, especially if it happened while I am in work,
I work in Financial Services and would be virtually unemployable if I was subject to a CCJ. I read that Courts can apply to put a charge on the property, but I take it they can't do this to my property just because I allow him to live with me rent free?
He would be homeless if he wasn't living here.
