    I think he's denying installing the boiler because after he'd installed the boiler we couldn't get the central heating to work so we hired another engineer to come and and look at it. Apparently he'd not fitted some pipe work correctly under the floorboards so the second engineer had to put it right. What the second engineer did had nothing to do with the boiler installation though. I assume that's why he's denying it although Gas Safe haven't told me that. It's all very Data protection to his advantage, it would seem.

    Why didn't you ask the original RGI to come back and remedy the defect?
    If the CH was not working, how on earth could he commission the boiler and sign off the benchmark paperwork? But, if he did sign it off, however negligently, how can he now deny installing it?
    Have you actually spoken to him about this since the dispute arose, or since the system was found to be no-functional?

    He did the work in August and commissioned the boiler and signed off the paperwork in August, so we assumed the central heating was working. It was not until September when we turned the heating on did we realise it didn't work. We asked him to come back and sort it out but he kept charging us as and still couldn't get the heating to work, by which time it was October so we contacted someone else to get the heating working. The second engineer said he'd plumbed it wrongly and put it right within a couple of hours.

    Unless you called out the manufacturer I cannot see how the boiler warranty is void - all the paperwork is completed.

    I can't believe you paid for the install without testing the CH-it would have taken a few minutes at most to test it. He's supposed to demonstrate the functionality and get you to sign off the benchmark to confirm this.
    Why was he then charging you extra for remedying his defective work?

    I know, we were very naive, we just didn't think. Believe me we bitterly regret it now.
    He kept charging us because he said it was all working fine when he'd finished the job and it must be a different problem.

    I think Gas Safe will now say that as someone else came in to put right the central heating that let's him off regarding the boiler. I which I knew more about it so that I am more informed when pleading my case.

    Can you get the bloke who put it all right to speak to Gas Safe, was he registered too?

    It might add some weight if another GS engineer is able to explain what a shoddy job the first engineer did!

    So what did RGI 2 actually change about the install? What does his invoice say he did? For a reasonable fee he will probably give you a written statement confirming the defect in the original install.
    Intriguing though this all is, the only real remedy you have here is an LBA, followed by a civil action if he is still in denial. You appear to have all the evidence you need.
