Can they do this?

Hi,

Ukcpm rejected my initial appeal against their £100 charge and sent a POPLA code for an appeal which after some proof reading from you lovely people I submitted at the end of March. POPLA acknowledged receipt and hearing is due in 2 weeks ish. This morning I received a demand for £149 from the debt collection agency they use giving 14 days to pay or costs go up. How can they keep pressing on with this when POPLA haven't heard the appeal?

The letter says that I've ignored correspondence from CPM sent to the address supplied by the dvla so they've traced me to my new address but that's rubbish! Ntk was redirected to me after I moved house and I supplied my new address when I sent my first appeal. They acknowledged this by sending the POPLA code to my new address!!

do BOTH of the above , giving the BPA the popla number and a copy of this debt collector letter

IGNORE the debt collectors like it says in post #4 of the newbies thread, and in here too

they should not be chasing it whilst its with popla, but there seems to be a rash of this happening at the moment, so a lot of "administrative errors" :)

Is it Steve.C@britishparking.co.uk? I've done the other one, just want to make sure this one goes to the right place.

This was the reply from Mr Clark....

Thanks for your e-mail and I am sorry to hear that you have been experiencing problems with one of our members.

By copy I am asking my colleague Gemma to look into this matter for you – she will be in contact with you shortly.

Please be advised that as we are not a regulatory body, it is not within our powers to make an operator cancel a ticket – I wish that it was.

The telling statement from that response!

However, they have sanction points available to them, which they seem alarmingly reluctant to utilise. Just look at the horrific catalogue of owd Trev's demeanours over the past years, which took the BPA so long to act upon - and there's still the burning question - was he pushed, or did he jump?.

'Regulation' is within their powers, providing they avoid 'copping out'.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I've thanked him for his response and listed everyone who will be emailed a copy of all correspondence if it's not dealt with. When I spoke to POPLA they let on that they'd had several similar calls recently.
