Compensation from Aer Lingus

My situation has a bit of a twist.

My flight from Dublin to New York was delayed for 4 1/2 hours in March due to technical difficulties.

I sent a letter along with the EU claim form to Aer Lingus and got their standard response back that technical difficulties are an "extraordinary circumstance ".
I know that the UK Caa does not allow this excuse any longer but it would seem that the Irish CAA does not hold their airlines to the same standards.

The same aircraft was delayed the previous day for the exact same problem.

My other issue is that I live in the USA so small claims court is not really an option.

Does anyone have any experience with the Irish CAA?
Any success?

I know my next step is the Irish CAA but have I any options after that as I am not in Europe?
