Thanks. I believe I have a good case as I made my intentions clear that I wanted to join the scheme at the right time and I have proof of this. I also believe that the Payroll department were negligent as they lost my form and did not respond to my emails. I am interested to hear other peoples opinions on this though.0 -
I am interested to hear other peoples opinions on this, particularly from a legal perspectrive. They have made a mistake and want me to pay for it. Originally they said that they would backdate the payments but then changed their mind.0

There's no evidence that you sent the form.

the fact that he raised the issue weeks before the deadline, and they did not reply would be some proof.
As if they had said no form was received, he could have fixed that in time. The fact they they never replied, means he has proof he tried to check on the application before the cutoff date.
Good faith. They have no good faith efforts here, incl their first reply saying they would put him where he should be, then reneging on the offer.0 -

What was the deadline? The OP's December 2013 is vague. I would expect a precise date.
The email in Dec 13 sent was vague. Given the deadline was known. Why no follow up i.e. phone call.
Likewise why no action until June 2014. As would have been very apparent that no deductions were being made from salary.
Facts paint a picture. Decisions are then made on the balance of probability.0
