    As you know, POFA does not apply in NI/Scotland, but I'm still intrigued as to why you think they are in the "dog poo" if they mention it? Please explain what exactly you think will happen if they mention POFA?

    because they are going to be breaking the law , just like CEL have done in Scotland and are in court for 12 charges of trying to obtain moneys by giving false information.

    Yes, I told you that the NI assembly doesn't even want to stop wheel clampers ripping off people, do you think they are gong to care when CEL say the "accidently" sent a letter mentioning POFA/POPLA because they missed the fact that it was an NI address.

    Don't get me wrong, I wish what you are saying was correct and that CEL does get taken to task, as in Scotland, but sadly I know what will happen is .........absolutely nothing. This is the reason the OP should just ignore everything.

    a fault or failure by the NI judicial system , would not stop this being kicked out in court the PRINTED law is the law , but more to the point the BPA would be forced to act and start issuing sanction points at a minimum of 6 per offence , this would quickly shut them up.


    I stand by my 2: , at any point on the paperwork you have received , does it mention POFA 2012 , or invite you to make a final appeal using POPLa ? , this is important !

    Can you tell me how you got on with Civil Enforcement Ltd, I received a penalty charge notice today and stupidly made an appeal??? I live in Northern Ireland and like yourself honestly assumed the weekly charge covered me for the particular day????

    Advice in NI (and Scotland) is to ignore! What did you say in your appeal?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Yes, appealing in NI is worse than a waste of time, it will be rejected and flag you up as a mug who takes these chancers seriously.

    However, all you need to do is ignore every letter they send you, the only thing that you would ever need to take seriously is court papers, and nobody in NI has ever received those from a Private Parking Company, check out my other posts.

    Ignore, Ignore, and then ignore some more.

  • Thanks for the update, in my appeal I asked Civil Enforcement Ltd to cancel the penalty charge, as I was a weekly customer, assumed I had made the payment, and made an honest mistake. I confirmed contacted Phone&Pay who would provide evidence I was a regular user of the car park.

    In that case you've identified yourself as the driver.

    As above, ignore everything you receive UNLESS it is actual court papers. (The chances of CEL risking this in NI is negligible). We DON'T need to know about every letter you receive. ;)
