Hi Guys

I don't know if anyone can help me, I have received a letter in the post from CEL about a car park that I use regularly, the only option to pay for parking is using the mobile app.
One day the app crashed and didnt register my parking fee (it wasn't taken out of my bank) I didn't notice until the next day. and low and behold a week later a letter lands on the door.

I can't seem to find out where to go to appeal or what to do, I see some users in Scotland are ignoring letters due to legal battles CEL are experiencing.

Can anyone help?

    yes , you are picking up the right info , N Ireland and Scotland use the same laws , and are different from England and wales,


    the basic difference is that the new laws set up in 2012 (protection of freedom act) did not cover N Ireland or Scotland .


    CEL are in a bit of bother , over in Scotland , where they have repeatedly tried to use the English rules , they are in (the Scottish version of) crown court charged with over 10 offences.




    1: do not reply to CEL , do not ring or write (if you get court papers , or the clear THREAT or court report back)


    2: at any point on the paperwork you have received , does it mention POFA 2012 , or invite you to make a final appeal using POPLa ? , this is important !


    please say yes to question 2 , and your cares will go away ,

    The only person that CEL could possibly pursue in Northern Ireland is the driver.

    If they don't know who he/she was, then, as the keeper, you're under absolutely no obligation to tell them, and they've no prospect of finding out without your cooperation.

    Does anywhere in their paperwork mention keeper liability and/or The Protection of Freedoms Act 2012? These apparently are the references made by them in Scotland, which now sees them facing the Scottish legal system.

    They work on scare tactics and the percentages game. As in scare enough mugs and x% (put your own figure in there) will pay up, still generating them profits, for least effort, that 99% of the UK population could only ever dream of.

    Next mug, please step forward for fleecing! Obviously not you now @OP. :)

    1 is 100% correct, do not contact CEL, their so called debt collection agents or any "small claims solicitors". Like 1000's have done so already, just ignore ignore ignore and they will go away. No Private Parking Company has ever taken anyone to court in NI, and hell will freeze over before they do.

    2 I don't agree with Freddy, none of this matters a jot, refer to point 1

    Actually it is point 2 which has landed CEL in hot water in Scotland. Might be nice to get them prosecuted in NI too. :cool:

    The NI assembly has decided that the continuation of wheel clamping in NI is just fine and dandy, do you really think they are going to pursue a parking company over some "errors" in their letters?

    The Scottish legal system puts the legal sytem in the rest of the UK to shame.
