Refund instead of replacement? Confused?

The I bought a dress online & it was marked when it arrived. I contacted the company who arranged for a replacement to be sent out. Once I received the replacement I was to send the marked dress back within 30 days however the company shipped the dress to my old address. I managed to cancel this before it arrived there & the dress was sent back to the company. They've now said they'll give me a refund for the dress I didn't receive but what do I do with the marked dress? Do I keep it as well as a refund? Nothing has been mentioned about it when emailing the company.

    No, but you're getting a refund, which is one of the options available for the seller to choose. In theory you should return the dress first and then you'll get the refund, but if they have said they'll pay it anyway you could wait until the money is in your account then send it back - the seller has to pay for the return in this case.

    I think that they think that the dress that got returned to them was the only dress that they have sent them? I think they've forgotten about the first dress which was marked as no attempt has been made by them to ask about the status of this dress. I've been messed around a lot by this company

    You wouldn't want to gain something you haven't paid for though. I'm sure you're not that sort of person.

    The company posted out two dresses.

    They have refunded you for one dress.

    So, you have now not provided a permanent payment to the supplier for the dress you have in your hot sticky little mitts.

    Stop the grasping, opportunistic attitude and do the honest thing - return the dress.

    Don't worry, they'll be back in six months, asking for help on how it isn't fair that a county court summons has been sent.
