    I dont think the phase of ESA is relevant either. If the son is on a means tested benefit then the non dependant deduction should be zero. I would want to see the most recent decision notice that shows all the income they are including in their calculations. These frequently show up that the council is either including or not including something in error due to them not being aware of the information

    as a side issue, you could get your local CAB to do a benefit check to see what you would get if you claimed carers allowance for your son (possibly carers allowance + income support) if he is getting the daily living part of PIP and plans to continue to live with you in the long term, and you are his carer.

    Have I read this correctly?

    No deduction when on assessment rate of ESA but once assessed deduction at the lowest rate?

    You are right that link says there is. just checked cpag 14/15 page 451/452. says
    'when no deduction is made....
    where a non dependant is getting income related ESA which does NOT include a work related activity or support component'

    so either shelter have themselves confused or there is more to this elsewhere in the book. Have to say, I had no idea that grouping affected non dependants so have learnt there. But it would not make sense to apply a deduction when the non dep has less money but not when their income increases

    There should not be a deduction whilst he is on assessment phase of ESA.

    10pence - each council does not set it's own levels for HB. It's a national scheme but we do for Council tax reduction.

    Somewhat confused; each council has a different LHA for example; Croydon shared room (SR) is £79.29/w for the outer south and £91.52/w inner south and Liverpool SR is £57.77/w

    Is it that central government set the rate and the local council pay it - that would explain my confusion?

    Hi 10pence, sorry, I thought you meant that we had different schemes as in differently eligibility criteria!
    The LHA rates are set according to Broad Rental Market Areas (BRMA's) and so although the rules used to assess claims are the same, the entitlement would be different. We are given the LHA rates from the Valuation Office.
    With regards to the ESA main phase / assessment phase info, DWP most recent circular for 2015/16 confirms no deduction until on main phase https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/389443/a18-2014.pdf
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.

    hi i have no deduction from son on housing benefit but i had letter today and housing benefit state they will pay 90p towards housing benefit a week

    n 0 for council tax how will i survive on this all because i claim child benefit for my daughter and tax credits they worked it out on last pay check 128.64 as that included overtime

    but still means i have to pay 82 week rent and council tax 89 mthly i get 190 child/working tax weekly and 20.70 child benefit

    im worrying so much i becoming ill

    you have around £300 a week coming in plus your sons ESA.
    after rent and council tax, you have around £200 to keep you and your daughter ( your son should be paying towards his keep from his own benefit.

    it isn't a vast sum, but should be manageable

    I suggest that you post on the Debtfree Wannabe forum (not just for those with debts so that they can have a look at your income and expenditure. They are experts at reducing expenditure - there is also a lot of advice on this website on how to reduce utility bills/phone bills etc.

    I work it out that you receive £328 per week and rent and CT is about £104 each week.

    Since you have 3 adults in your house then I can imagine your bills are quite high.

    Without wishing to be harsh the only way you can make ends meet is by increasing income or lowering expenditure.

    In view of your having 3 adults you are going to have to make some harsh decisions. If you cannot get more work then what about your daughter getting some part time work - this would at least pay for her personal expenditure instead of you.

    As I said before, although your son has special needs he is still eating/using the utilities. He should be giving you some money towards these and using the rest for his personal needs. If he cannot be made to realise this then you will have to apply to become his appointee and take charge of the money.

    What is your daughter going to do when she leaves school? You need to think ahead too as you are going to lose money unless she works and pays money for her keep. How will she feel if her brother isn't paying his share?

    I am sorry that there is no easy answer.

    Is the father of the children around? Are you getting any financial support from him?
