1. Send the PoPLA result to the BPA with a complaint that UKPPO is in breach of the Code of Practice by issuing charges where no independent appeals service is available.
2. Complain to Trading Standards that UKPPO and Newcastle Airport are breaking the law by pretending to issue penalty charges where they can't.

Thanks for the advice bazster and HO87. What is also amazing is how it has took POPLA 5 months since acknowledgement of my appeal to realize they that they do not process appeals for Penalty Charge Notices. Also why on earth was I directed to them in the first place by UKPPO when I decided to appeal?0

Because UKPPO is a member of the BPA and the BPA Code of Practice says they must offer PoPLA. The fact that they can't offer PoPLA means that both the BPA and UKPPO are now in a right old pickle over this. It's been coming for a long time at this site where the entire operation is nothing but smoke-and-mirrors.Je suis Charlie.0 -

But are not signed or apparently endorsed by the secretary of state.
I would therefore write back to POPLA and request them to hear the case anyway because the byelaws are not signed, and so the charge is NOT a penalty charge after all. Also point out that as per bazter's post this is not covered by the byelaws even if they were in place as the road is one in which RTE applies.

Thanks again everyone for your advice. Looks like I need to knock up another letter. I wonder how soon it will be until I receive any correspondence from UKPPO regarding the POPLA decision. I'll let you know what they say, (if they come back!)0

I've checked through my emails and I had semi drafted an email for BPA but in the midst of trying to sort out POPLA appeal, I didn't send it off. But will get that sorted out asap.
I was wandering the same as to what will happen now. Will UKPPO still try to pursue this?0 -

The ability to prosecute under byelaws expires after six months, so this will be sometime in October.
Is it 6 months from the date of the alleged offence? If so, as the invoice was issues in mid February, it is well over the 6 months! Does that mean that they cannot pursue me further?0
