Hi

Further to my post last week, I now have some more information and would appreciate some help on how to proceed.

I have had 6 loans from First Direct for which I paid PPI, they were all rolling loans between 1995 and 2000 - there are a further 4 from 2006 onwards without ppi and I think there was probably a period between 2000 and 2006 where I had no loan in place.

I now wish to try and reclaim some of the ppi but need some advice.
In June 1999 I became ill and was signed off work. I was on a lot of medication and have very little or possible inaccurate recollections from around that time. There is a chance that I claimed on the PPI at that time as I had a Debenhams store card and I know I claimed on that so it makes sense that I would have claimed on the loan as well (If this is the case the loan in question would have been taken out in May 1999)

My grounds for complaining were that I was not aware that the PPI was optional and that I had a corporate health policy that paid 75% salary after three months sick (the first three months were full pay).

If I have claimed (assuming that my feeling would have been that if I have the policy I might as well use it even though I still had income) would my case be weakened?

As an alternative there is one loan which was taken out in 2000 when my condition was obviously pre-existing, should I just complain about that one?

The last option is to complain about all the loan numbers aside from the one with the potential claim, or would they have to look at them all?

Sorry if this post is long and confusing, but any advice is gratefully received.

If your complaint is successful and if they have kept records, they will deduct your claim from your redress.
A pre exisiting condition does not include mental health issues, or things like asthma unless the latter is ocmpletely debilitating.
Probably better off adding in single premium where the full cost of the insurance was not explained fully and that you weren't aware you were payig interest on the insurance too.

Sorry if I'm a bit slow on the uptake, but could you just explain the single premium bit to me please?

The nature of my illness was mental health , but if I had not returned to work when the 2000 loan was taken out (which I hadn't) would that not have excluded me from claiming?

Single premium is basically the PPI is added onto the loan so you pay interest on the PPI element as well as the loan so you pay back more - it's a big no-no and 99%+ of the time would win a complaint if the firm was regulated

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

If you were unemployed at the time you took the loan out then it would.
If you were being paid sick pay and employed, it wouldn;t.

    Go with single premium.

Thank you both for your responses.

I was employed and being paid sick pay when I took out the loan in 2000, but the others were prior to being off sick.

Do I state all the reasons for disputing it (having sick pay in place, not being given an option and single premium) or do I simply go with single premium?

Thanks again, I appreciate your time and help.

    Sick pay and seingle premium.

You would have been given the option, you would have signed for it. And using that excuse is an unprovable allegation whereas the other two are factual.
