The IAS are considered very biased towards the parking companies and although some appeals have been upheld it is only a small percentage.
No-one can say whether you may be one of the small percentage.
You will need to decide whether to bother with an IAS appeal. Opinion is divided.
But the chances of a court claim are slim from this company.
The chances of winning a court claim are higher than getting an IAS appeal upheld.
Some think higher still if you show you have been reasonable and followed all appeal processes and the ludicrously biased reason why your appeal was turned down by IAS won't harm either.0 -
Not sure about the POPLA; does it not apply to me ?
Yes - 21 days to appeal; I'll give it a go; nothing to lose it seems.
Thanks guys0 -
...also, I didn't see an Appeal Verification Code on any of the correspondence sent to me. Is that relevant/helpful?
Thanks again0 -
sort out your draft appeal to the IAS and then put your pcn number in on the IAS website (its run by the IPC)
no , popla doesnt apply as they are IPC members, not BPA members0 -
Similar points of law apply to both POPLA and IAS appeals though.
The wording on any signs that were around is important as this will be what they claim gives the terms of the contract allegedly entered into.
IPC members claim the charge is a contractually agreed sum (i.e. a tariff) for parking.
Wording on their NtK and rejection letter is also important - so look out for any indication the charge was actually for breaching the terms e.g. words like "failing to comply"
Few examples of IAS appeals will be found here

Also use the Search the Forum function with the Search term PCM or even the location to find others who have recently dealt with PCM Ltd.
Post up your draft IAS appeal for comment if you'd like input from forum members0 -
Take a look at post #40 of the IAS thread I gave you the link to before.
It links to a winning IAS appeal against PCM ltd and may have content relevant to you

If you didn't see the programme, it's worth checking it out on catch-up just to see what sort of people you've been dealing with.0
